Yeah this alone is why I never call them anymore unless its something critical and even then its just about impossible to get anything accomplished. I just did two obsolete disputes with them today online. Ive found the best tactic when dealing with EQ is to dispute online first then if they fail at that then file a CFPB complaint if its legitimate. Seems the only way to get them to report accurate information.

I only wish you had dealt with my special handler at EX. It is like going on a death march.

I must be lucky, cuz mine is a sweetheart. Both Anna & Amanda at EXP's SH have been great to work with. Maybe you can ask for a transfer to a new handler?

Thank you for this and I think you're 100% right. Online dispute will be my next step, and then CFPB if that fails.

I believe mine was for a CFPB complaint. It's the only thing I believe I could have done to warrant "special" treatment.

Disputed EX in October online as obsolete. Date to fall off is Feb 2015 on report. I haven't been able to dispute online since in November or December. I tried to call and they said they wouldn't remove until February.

Started another round last night with TU...

 

Currently I have (3) CO's. I disputed all three. Two should be gone but the third one is scheduled to fall off in 9 months. Did it for the hell of it. Worst case, knock it out in March or April.

 

(EQ report should be coming any day)

Oh...special handlers...aren't they fun?

 

An entity that meets the definitional requirement for a "consumer reporting agency" (CRA) in Section 603(f) of the FCRA is covered by the law even if the only information it collects, maintains, and disseminates is obtained from "public record" sources.

 

Section 603(f) defines a "consumer reporting agency" as any person "which, for monetary fees, dues, or on a cooperative nonprofit basis, regularly engages in whole or in part in the practice of assembling or evaluating consumer credit information or other information ... for the purpose of furnishing consumer reports to third parties

 

I wonder if this could be interpreted as not only obviously EX, but as to an employee of EX as an individual. Especially a special handler who, as your sole contact with EX, has the final word on all the decisions that relate to your...er uh sorry their files that contain your information.

 

I've been thinking of playing dirty. And filing a small claims case against not only EX, but my "special" handler as well, for FCRA violations. Wonder how they'd feel when they got served? Funny the same public record info that they use against me I used to find them.

I know that someone filed a small claims lawsuit against them in NYC in civil court for not following the NY 5 year purge law...

 

I will check in with that person to see how it is going...

I waited patiently for months until today, December 1st, to dispute as obsolete with Equifax an old LVNV account which has been reporting incorrectly for years. DOFD is incorrectly reporting as Jan 2008 (it's actually sometime in 2007, but that's another story). So I wanted to be patient and not try too soon before contacting EQ to have the best chance of getting this deleted by the end of 2014. I made 12 different calls today over the course of a few hours, trying to find the "right person" to help me with a courtesy deletion (for an account that shouldn't be reporting anyway because it's well past the reporting SOL).

 

A few times I asked to be transferred to special handling or the executive consumer dept. Those transferred calls seemed to just go to someone else in the cesspool which makes up the body of EQ's phone reps.

 

On one call, my explanation of why LVNV should be deleted was met with a pitch to purchase EQ Complete and ScoreWatch. Every time I declined, the rep kept going back to his hard selling approach for their paid services. On another call, a rep told me LVNV would stay on my report until Nov 2021 because under the EQ "retention policy" negative items stay on consumer reporting files for 7 years from the date of last activity and apparently that date was last month. WTF?!?!?

 

Another rep actually advised me to settle the account. I'm not making this up. He said in his broken English accent that negative accounts with a balance will stay on EQ reports forever unless they are settled and then they will only stay on for 7 years after that. I laughed out loud and hung up.

 

Yet another mindless EQ rep told me that he could not remove the negative LVNV account and advised me that I should be prepared for a judgement from them soon and that a lawsuit was likely. Never mind the fact that this account is well past my state's SOL and that I had actually already been sued 5 years ago (and won) on this account back when it was with Arrow.

 

So yeah, today was a fun day. I think I will either try again tomorrow either by phone or online. Or maybe I will just file a CFPB complaint.

 

Everyone has their opinion on who is worse (EQ or EXP) but I have had great success with EXP for obsolete and other disputes using the phone and also directly through special handling (fax, letters, phone calls). And terrible success with EQ unless it was an online dispute.

Wait a few days and try again. With my most recent EQ obsolete attempt, I called them on the phone hoping to get a quick delete (with 5 months remaining on a TL that is actually reporting correctly). Instead of a quick delete, they went the normal dispute route telling me I'll get the results in 30 days. To my surprise it was deleted about 10 ish days later. I seriously doubt there was any verification, who knows what happened.

I hope this is not off topic,

 

I was thinking of disputing some old EX inq's that are 23+ months old. I have one dated 11/24/12 that's still sitting there and 4 that are due to fall off in this month. I don't want to be inpatient, but it seems like EX is in no hurry to remove them.

 

Does anyone have any experience with this? Do I need to push EX?

I am in the middle of HIPAA process so I'm not gonna jumble this obsolete stuff up with it. With that being said, if by the 12th of December, TU has removed all 5 entries from my report would now be the time to dispute as obsolete for an entry that is scheduled to fall off on 5/2015?

 

If the 5 entries are not deleted then I shall continue on with the HIPAA process on TU and save this for later.

 

At this point, you might wait till January - they seem to be more receptive to early deletes when it's in the same calendar year (no hard math involved :P )

If I recall correctly, you and I are on the same boat. You're waiting for old CO's to come off?

 

I have issues with EX too. They don't let me dispute anything online since they've been "verified" in the past. All I can do with them is wait. 2015 should be a good year for me (God willing). All of them should drop. I am just curious about the ones that don't show a date that they'll fall off. Instead they show "updated". I guess with those I might have to go the manual route or chat when the time comes.

i have been busy building up credit cards and not working on my Ex since it is frozen. Also working on mortgage. Will resume clean up in January. Lots going on, illness in family, the mortgage, DBF's impending final divorce settlement (after 5.5 years), some litigation in SC... endless. And a big move with a lot of work to be done. All should be settled in early 2015. Looking forward to some peace.

Either way. Sometimes it's a good strategy to sit back. A lot of times answers are right in front of you and you can't see them until you take a step or two back. Focus on the other headaches right now. Let your CO's keep aging and get around to it when your current stress is no longer there. ;)

Woke up this morning to see that EQ is no longer reporting LVNV on my report. Christmas came early. :)

WOW!!!! getting rid of a collection is major... Were you expecting this?

 

I woke up to a reported change in my Ex report. All Fico's are in 700's now except Ex at 698. Would love to get all in700's within the next month. That would be all I want for Christmas.
