Helping a friend with a Credit Management LP derog for $95.00. The credit report is not showing a DOFD, but it is going to some time in 2013.

The original creditor was WOW Cable, it is balance of a cable bill. He never received a bill in the mail.

Will the DV alone be enough or should he use the one-two punch:

I'd like your feedback on the one-two punch versus simple DV and your feedback on the DV.

Here's the DV:

Re: 1234XXXX

Dear Credit Management,

You have added information to my credit report. I dispute your claims in their entirety and request validation pursuant to the FDCPA.

Be advised that I am not requesting a "verification" that you have my mailing address, I am requesting a validation, that is, competent evidence that I have some contractual obligation to pay you. Also, please provide the original creditor's name, address, and date of last activity.

It is inconvenient for me to communicate by phone. Send all communication to the address above.

Sincerely,

My Name

This letter is fine. I'm an advocate that the shorter the letter, the better.

Confusing. If I dispute now, then I'm sending a dispute to the CRAs, right? Not online.

It seems that CMI went and said something to EX about the DV, I'm not sure what that means. I get the impression that CMI is not going to fold.

@mindcrime Is this the one-two punch flow? Why wouldn't they have to respond to the DV?

TTT, because it's the weekend. Sorry to be a bother. Not sure what to do next because when I send a DV for my baddie my JCB just folded. My friend's CA responded. Not sure whether to PFD or pay the OC to undercut CA.

Posted

The DV letter returned. It is a cover letter plus a copy of the last WOW Cable bill.

They've validated. They did not remove the baddies themselves.

What is the next step?

You can pay it but it won't make a difference, utilities/cable never PFD.

If the goal is to have the OC TL show a zero balance then your friend should try to get the OC to take the payment. Look up Credit Management LP on the better business bureau's website (bbb.org) and read through some of the complaints. You'll see that this CA will do deletes in response to bbb complaints.

@TX-Bluebonnet The goal is to have it gone. It is his only baddie. Pay it and he's acknowledged the debt. It's only $95 and there is no pressing need for credit so happy to take the time and Jack attack or whatever it takes to get it to go away. Otherwise live with it as a reminder.

@ProcessServer It isn't a cable company, it is WOW! Cable. I think they also sell mufflers. http://www.wowway.com/home-map

That's why it's helpful to let people know what the goal is, but sounds like you already know what to do anyway??

Not really. I'm helping a friend after having successfully removed one baddie from my report. My baddie just dropped right off. This one responded to DV.

So, no I don't know what to try next. I only know that I'm willing to try a lot of things before just paying it. So, what is next PFD? Or let it age and then Jack attack it? Any guidance is appreciated.

TTT.

This is my second time taking on a baddie, but this time for a friend, showing him the CA-Freedom Unlimited-jitsu I learned at CB. Unfortunately, this CA has got some moves. Instead of folding like ERC, it sent a validation letter, a cover letter with a copy of the final bill.

I'm stumped. What is the next step? Should I send back more validation, asking for specific points; proof that CMI holds the debt, license to practice in state? Should I contact the CRAs and start Jack attacking? Should I offer a PFD.

CMI has reported the $95 baddie. WOW! Cable is the OC. DFD is sometime late last year.

Posted

When I dealt with CMI, I paid the OC and they recalled it.

It looks like they've satisfied the DV request, so if you're in no real hurry, I would Jack Attack.

But for $95, you may wanna consider a PFD and put it behind you.

Since DOFD was last year, I doubt you'll get by with any settlement, so I would approach the OC first and PIF for delete.

Posted

@HoustanLynne Yes. I have no desire to settle the $95 for pennies on the dollar. Just want the baddie to go away. So, pay the OC for delete? That's what I'm looking for a next step. Also, yes, the bill is recent, I don't believe that it is going to go away. Would be happy to just pay the $95. When you paid your OC did you negotiate over the phone or did you send a PFD letter?

Posted

@HoustonLynne And thank you for the feedback. I was stuck. Feedback gives one courage, because you don't know if you're missing something. Seems like PFD is easiest. And yes, plenty of time, so if no PFD, some longer term strategy to remove it, i.e. Jack Attack.

Sorry, I just saw your question! And you're more than welcome on the feedback.

My situation was a little odd, because it was before I started hanging around CB, so I didn't know how risky it was NOT to get the whole thing in writing before paying. And it was also a genuine case of ID theft -- a family member used my info a year earlier, and it was charged off in late 2012. CMI had it for collections. I called the OC (Time Warner) and explained the situation (I don't recommend doing that) and they said I could pay them and they'd have CMI delete. They said it may take 30 days to come off the CRAs. I got impatient, so I disputed with the CRAs a couple of weeks later and it came off -- was likely in the process of being deleted already. They had verified it at least once a couple of months earlier, before I paid it, so I doubt my new dispute was useful for anything other than soothing my impatient nerves...lol.

I BELIEVE the way that would go is you'd make your request to the OC in writing and get their confirmation IN WRITING that, upon full payment to them, it would be recalled from CMI, purged from CMI's records and entirely deleted from all CRAs -- NOT replaced with a "paid" collection.

Or if you're inclined to try a bit harder to hang onto your $95, go with a Jack Attack first. :aggressive:

@HoustonLynne I called the OC, WOW! Cable, and the first ring CSR said that they can't recall the debt. I asked her a lot of questions for a future Jack attack, had her send the last six months of bills for more Jack attack material. I didn't bother to escalate the call. I then called CMI. Escalated from the first ring CSR to the "Office of the President" and was told to send a request for delete in writing. Faxed a basic PFD.

Waiting to see what I'll get back. Started a new thread here at CB specifically about the PFD. Your story, plus other responses leads me to believe that CMI will honor a PFD. If they do, then I'd have no choice but to say good things about CMI if asked.

If the baddies don't drop off, a Jack attack would probably be easier if no one is collecting anymore.
