I just received in the mail today a letter from the judge saying "motion is denied, plaintiff having failed to establish a prima facie case".

I am so excited here..and I owe it all to this board and all the menbers who helped me. You're terrific. I can't PM anyone as I am still a newbie so please help me reach all the vets on here to say thanks.

Account # xxxx from XXXX is a fraudulent entry on my report. I have no such account for this amount for this date from this creditor. I have Court documentation which substantiates my dispute.

 

If this account is verified, please provide me with the name and address and the method of verification so that I may pursue further legal action.

 

Send it in a hand addressed envelope, certified but NOT RR.

Now that I have this dismissal can they(the ca or oc) revisit this at any time? Can it be sold? Or is this a dead issue?

They can try to sell it, however it would be easy to dispute off.

Yes, you can add the unpermissible pulls to your letter, and state that the same requirement on verification applies to these non permitted inquiries as to the fraudulent entry.

I'm in the same process right now. I got a letter from Midland saying they instructed the CRA's to delte... now I just have to follow up this week and see if they actually deleted.

Am I missing something? I understand that the motion for Summary Judgment is denied, but I don't see that the case was dismissed either with or without prejudice.

Why Chat Was wondering about post before this one from extracredit? Case is dismissed right? Also only entry on my CR is from original creditor who sold this account back in 04 to this ca. Ca has not reported anything only 2 inquiries. Can I get the original creditor diputed off then? Thanks

If they failed to establish a prima facie case, that means there is no case at all.

Maybe. You're going to have to get them for reporting violations if there are any or get lucky with an obsolete dispute. Still show a balance?
