that is what I was thinking. the flooring is not maintenance but updating from old carpet/vinyl to laminate flooring. The outside part is maintenance, the house was originally stained and the carpenter bees got several boards good last year, then the woodpeckers tore them up. So we will be painting instead of staining this time around to prevent a reoccurrence. amazing how much cosmetic damage they can do in a short period of time! I might could get this fixed before we start the process, but right now is not a good time for me due to work and the short daylight in the evening. Seems here lately every weekend is rain, so I can't do any of the siding/painting! the flooring I have now will finish out the rear of the house, but still a good 1/3 will be original 1978 orange vinyl. I may have to wait until December to start the refi process, tha tway I could get the floors finished and the outside portion done before the appraiser would be even called in. How would a cash out affect the loan? I don't want to put any money in my pocket off the loan or consolidate anything but the 2 mort notes. would going for a fixed be the best option, or on a cash out would it be better to go variable for now then refi it to a fixed a few months to a year later?

It has been a while since I've been on CB, but I wanted to get some opinions from the experts here. in July 2010 I filed a CH7. My lawyer messed up and had me reaffirm ONLY my 2nd mortgage. I could have sworn we signed to reaffirm both but according to the courts only the 2nd was. Since the BK I have not really opened new credit, just one store card a few months ago that I have not even used yet. I have paid on time both mort notes in the 4+ years since discharge. I also paid off a credit line on my lawn tractor which I kept in the BK as well. Currently the first has a balance of about 106k at 6.6%, the 2nd is 61k at 9.375%. I do not pay escrow, the combined P/I payments on these 2 loans is about 1336.00 a month, then I pay about 1400.00 annually for taxes and another 1400.00 for flood ins. My HOI is about 1250.00 annually. What I would like to do is refi both of these into one loan and escrow taxes and insurance. the first mort has about 20 years remaining, the 2nd has about 23 years remaining. If possible I would like to refi into a 15 or 20 year fixed, I don't really want to start all over on a 30 year loan. A little history on this. When we bough the house in 2004 the mortgage broker talked me into doing a 1st and 2nd at a 80/20 split so I could get away with no PMI. then a couple years later I refi'ed the 2nd to consolidate some CC bills. The 2nd's was again refied about a year later to drop the rate to the current 9.375. Here is another kicker on the refi, my wife works for a bank and has talked to the loan officer there. She says to refi the 2nd into the 1st it would be a cash out loan?? also said the appraiser would ding us on the report because the house needs a little work. We are in process of redoing flooring, but there is no way to get it all done this year. It also needs painting and a few siding boards replaced, again doubtful that could get done this year. Any idea on how bad this would hurt us? We do plan on the refi being in both our names. She did not file BK when I did, as it would potentially cost her job at the bank due to periodic credit reviews. Her credit is excellent, mine I am not sure as I have not recently pulled my reports. Our combined gross incomes are around 80k, though last year mine alone was more than that due to some bonuses off big projects which we won't have for the foreseeable future. Currently out DTI is about 45% for the 2 cards my wife has, her truck note, the mortgages, and ins/taxes we pay. She has a small loan for her mother's funeral expenses, but it will be paid off in the next 10 months or so. Not sure how this affects us. Anyway, what are some options I can check into? I won't just shop this at her bank, I will be checking around for multiple options.

when i was 21 i got a DUI while out of state with my cousin. when he called my mom and told her, her response was "let his A** sit there" and then she hung up the phone. if not for my cousin borrowing money from his folks, i would have been in there for a while. the nearly 24 hours i spent in Escambia County Jail was enough to convince me to change my ways! so i would have to say yeah i would bail immediate family out, but only after they sat there for a while.

the key to a good paint job is prep. normally you scrape/sand, but since this is lead and asbestos, i would recommend pressure washing. the dust is what gets in your lungs, and by pressure washing you won't have dust. then a good primer, then your paint. if you tint the primer the same color as your final paint, you won't have the issues trying to get even coverage. take the time to fix any rotten wood, loose boards, etc.. before you prime so that it all comes out even. my wife is the kind of person who will just walk in a room and slap paint on teh wall. then she complains a few months(if not days) later when it looks like crap or starts to come off. i will spend an extra day or even two just prepping and repairing first, so i get a good looking finish. i hope to be able to take a week off this fall and paint the outside of my house. i have a lot of woodpecker damage, so the prep work is gonna be killer!

Freezing produce... what can you, what can't you?

for a lot of freezing/canning directions visit www.pickyourown.org. i found it while looking for a pear butter recipe and now i am hooked. so far in the last 2 weeks we have frozen 160 ears of corn whole in the shucks and creamed abother 50 ears or so. plus canned over 100# of tomatoes! there is nearly a bushel of pears in the fridge finishing ripening now, and at least a 55 gallon drum worth of pears still on the tree! then my garden is really putting out okra/lima beans/speckled butter beans/tomatoes as well. oh, and you CAN freeze leafy veggies such as spinach/greens but not lettuce. you just blanch then first, and freeze them. i even slice and freeze green tomatoes for fried green maters year round. -
i may be way off base here, but maybe just you being there is causing problems between your sister and her BF. or adding to other existing problems they have been ignoring. i don't mean because you are basically dependant on them, i mean the simple fact of another human living in the home with them. back when we were still just dating/living together, my wife let her brother move in with us for a couple months. it got to me quickly because i got tired of him being there all the time. sometimes i just wanted to come home and spend time alone with her, but there he was sitting right there. he really did nothing wrong when he was with us, though i would complain he did. he was just going thru a hard time and had no where else to go. i agree with the poster above, if you cna find a GOOD women's shelter maybe this would be better on all of you. if you have all the problems mentioned above, you don't need the added stress of your current living situation either. whatever happens, good luck and i hope things turn around for you soon!

How do you officially determine property ownership?

when i filed this was specifically asked by my attorney. i told her i had some work related stuff at home or in my truck at all times, as well as some property that belonged to my stepdad. all we had to do was a rough list of what i had. she said IF the trustee questioned it i would hav eto get affidavits stating exactly what belonged to someone else. it all depends on the trustee, your attorney should be able to answer this for you. -
i got my chargriller for Father's day 2001. so far the ONLY issues i have cropped up this year and that is 1 wheel cracked and the charcoal tray finally burnt thru. to give you an idea of how much use this grill has seen, i normally go thru 4 18# bags of charcoal a WEEK! during warm weather and about a bag a week during winter. the charcoal tray is easy to adjust, you just grab the handles on either side and lift it to one of 5-6 preset heights. i honestly leave mine all the way down because i believe in cooking slow. but if raised high it will sear meat quickly. the cooking area is large enough that you can easily have a warm and a cool side. for ribs/boston butt/etc i used to build my fire on the right, put a drip pan next to it fill with water, and then put the meat on the left. this kept the meat from burning and allowed me to cook them slow for falling off the bone ribs. i got the sidebox a couple years later and that was the BEST investment ever for smoking meats. plus it can be used as a small grill if you just want to do 10-12 burgers(yes it has that much room!). the original design that i have has the sidebox on the same side as the wheels, where the new style puts it on the opposite end of the grill. i believe they did this because the weight was causing the wheels to fail. the one drawback to this grill is that you cannot damp it all the way down to the point it will put out the charcoal. my cheap 20.00 tabletop grill i can close the vents and the charcoal goes out. then the next time i need it i have enough to just relight. but with the chargriller there is enough breathing room that it will not smother out. not a big deal to most folks, as they don't like to reuse charcoal. it also take a while to assemble and a couple hours to season the grates. but once done it is a solid grill. i wipe my grates down with a paper towel soaked in veggie oil. just let the grates get hot, wipe them down, then go to cooking. this keeps them clean and non-stick.

i would inform the daughter of who he is and where he lives and tell her under no circumstances is she to even talk to him or be near him. if she rides her bike she MUST stay in a group and if even 1 time she leaves the group to ride alone no more bike riding. now on to the conviction, you really don't know what he did. i have a cousin who's record reflects basically the exact same offense. he was in his early 20's and met a girl at a bar that allowed you in at 18 but you could not drink. he went out with her a few times, they had sex, then they split up. next thing he knows he was being arrested! turns out she was barely 16 and her parents filed charges. his record shows that he commited a sex act against a child, when he honestly thought it was mutually consensual sex between adults. this is where the sex offender laws need to be uniform and clarified, i dont have a problem with someone who was in a situation like my cousin was, but i have a BIG problem with someone who stalks and rapes a small child. but the way current law is, there is no distinction in many cases.

same for me, whoever takes the kid to the doc pays the bill and approves the services. they then have to collect the money from the other parent. she really has no legal obligation to pay you, since she is not signing anything. i bet that's why she won't keep her appointments, so that technically she did not use your service and you can only go after him. sounds like typical petty scourned exwife bs to me.

ok, bear with me because this can be hard to follow. My father in law bought a home and a couple acres back ~2000 or 2001. his dad and stepmother cosigned on mortgage and all 3 were listed on the deed. about 2003 the ballon note was due and so a refi was done. for some reason, i have no clue why, the refi was done 100% in their names with my FIL not being on the mortgage for his own home. at the same time they signed the Deed over putting the property in his name and my wife's name! yes, you read that right they took out a mortgage then after the fact signed the deed over. it must have been a timing issue, because no one ever realized this had happened. in 2007 the mortgage was refied AGAIN due to the ballon note coming due(why oh why do these things exist for non-investment property), and the bank let the grandparents refi in their name only and never even checked to see that they did "own" the property they just took a mortgage on. thsi was the same bank as the previous mort, just a straight refi so i guess they skipped the title search! fast forward to recently my FIL decides he wants to take out a small loan as a 2nd on the home to get his home business up and going. this time the bank realizes what is going on and tells him he cannot borrow money due to the lien being screwed up. i told him that knowingly or not they have commited a major felony and they MUST act to cure it now, hopefully before the bank decides to A: call the note and/or B: press charges. he wants to call teh bank to talk about it, my recommendation was to contact a GOOD RE attorney. am i correct in assuming that if they pay off the loan in full the bank COULD still go after them for fraud? can they even go after him since he never signed anything with the bank, just his parents? i told him that they could be looking at major civil and criminal proceedings. he said this is all the bank's fault and he don't see how any of them could be in trouble. i say it is all their problem, possibly my wife's as well. i was trying to figure out how the last refi was done without my wife having to sign off, and now we know that the bank was never aware the borrowers were not the owners on record of the property! he does not want to screw over anyone, the bank nor his parents, he just wants to get the mess straightened out. any advice is appreciated.

Yep. Last summer, a friend and I dropped off my buddy at his apartment. He couldn't find his apartment key so he just decided to sleep in his car. He turned the car on for the A/C and was given an APC (Actual Physical Control) for being in the driver's seat of a running car, even though he had multiple witnesses say he was dropped off. my cousin got a dui for APC and she was asleep in the back seat of her car. the cops said as long as she was IN the vehicle with ready access to the keys it was chargeable. they her that next time she should give the keys to someone and have them bring them back to her later!
