I did a little research on Jefferson Capital and their methods after they filed suit against a friend of mine on a Tribute card recently ( or so she thinks as there is no name on the suit,just the last few numbers on the account ) and that was outside statute by at least 14 months.She was served by a retired Police officer who now acts as a "paper server" who was also told when he served the papers that this was well outside statutes.And he was told that by me and I'm a retired Police Officer as well. What I have found is that Jefferson Capital ( In my friends case anyway ) buys these old junk debts for pennies on the dollar as has been stated here in other postings and then attempts to date them with the date they purchased the junk debt which I think is a Federal violation.In this case the statutes expired 14 months ago but Jefferson shows the debt as 2010 with the CRA's.They then file suit based on that date and I am thinking they then hope the debtor does nothing so they can get a judgement,so make sure you answer the case. My research has shown when the few debtors that do answer explain it is outside statutes,Jefferson doesn't follow thru on the suit and it is dismissed.These debts are so old that Jefferson has no idea or documentation otherwise anyway. In my friends case,she has answered the suit theu Attorney and will wait for the dismissal and then she will file suit thru another Attorney who has already agreed to file suit against jefferson for the violations.She will then file a complaint with the State agency that oversees Paper servers based on the fact she gave the paper server every opportunity to take the papers back and tell them Federal Violation/s were being committed. Then she is filing a complaint with the Michigan Bar against the Attorney handling the case for Jefferson. Lastly she filed a complaint with the FTC based on the violations. That should hopefully keep them from ever wanting to pee on her flowers again. And she will take a nice short vacation with the Violation monies she will get from Jefferson I am sure.

Well,it's been a few years since I originally wrote that post and wouldn't ya know it,My girlfriend of 10 years get's served by a process server no less for a credit card debt that is well outside the 6 year statue of limitations by about 9 months as best we can tell,which is a new one for me.I never thought a collector/attorney would ever chance something like that. Any thoughts? So,I'm back on the boards again to get that straightened out and get a few tips on cleaning up some minor credit pull issues on mine and a well outside statues medical collection on my credit file that seems to be re-dating itself at will,lol.

I'm a retired Police Officer and can tell you that it is even taught in the Police Academy that you should never talk to the Police or an investigator without your attorney,EVER, and I used that thru out my carreer. I hate to even admit it,but it has been my own opinion thru seeing first hand that many Academies are teaching to violate civil rights in traffic stops as an example by what they use as probable cause. I was a Cop for 24 years and I don't trust cops,lol. BUT I ALSO NEVER FAIL THE ATTITUDE TEST,so that I may live to fight another day with cash in my pocket,left there because I was a good flowers kisser at the time. Most people prove their guilt by opening their mouth. It is a Law Enforcement Officers job to prove your guilty be it a traffic stop or otherwise,why the hell would a prudent person help them do it?.   4. So with the help of you CBr's,I get a judgement removed a few years ago from TU and it was actually easy enough as it wasn't mine. So,in my 2 year quest,I had almost all my CRA's looking good,even Experian,lol. My scores were climbing and I was just filing out the paperwork for a new small mrtgage on my home which is already paid for and I go to check my fico's and there as big as day was this judgement,,,,,,,,,AGAIN,,,,,except this time it isn't in the original name of the Attorney/Collector who supposedly did the judgement. Now it is in the name of the orginal creditor,same judgement number and re-aged 2 years. After I got done laughing so hard I puked my desert from supper,which really pissed me off cause it was the best early straberries I have ever had,,,,,,,I thought I would post it here and get your view. What I did was send a rather long hand written letter in ink on yellow paper screaming fraud,LMAO,,,,,and letting them know that I hadn't even gotten to Federal law yet as I noticed they had violated at least 2 state felonies in the state the judgement was supposedly done and that I expected to see it removed immediately or I would file complaints with at least 3 States Atttorneys and then look at the Federal laws broken and file a lawsuit against them.I am abit pissed mind you.And sent it green card. SO I am sure I just got myself a fraud alert,lol,but curious what they will do and what I should do next if they don't understand what I told them. So opinions and help please. Also,what concerns me from reading here and writing the CRAs is they seem to think an investigation is complete if a computer or a vendor says so. I was a Cop 24 years and even I know better than that and have told them so. Whenever I have to write a CRA,I make a point of telling them I expect a full and complete investigation don by a person/s and not a machine or a Vendor and then I show them just abit of my own investigation and tell them I refuse to do their work without being paid for it,and let them know I have more,and I do,not bluffing at all. If the medical procedures were done in a hospital setting,even if it was out-patient,then contact the hospital and let them know your particular situation and let them know that your lowincome ( only assuming you are based on your post ) and ask that facitilty if they have any programs to help you. All hospitals have programs to help folks with no insurance or those with insurance issues such as yours. Fact: recently my own girlfriend who has insurance but maxed out her plan feel into the same situation when we had to take her to the hospital for an emergency situation. The total cost was 12K plus 1100 for the ambulance.We contacted the hospital via mail as I just explained to you and within 2 weeks got a letter back explaining the entire bill/s had been covered. My girlfriend then changed her policy so she won't have these issues in the future. So try it,as it may help you and save alot of collection grief down the rode.Even if they won't cover it all and only cover say half of the bill,you can then set up a payment plan for the balance. How is it that a fly can fly upside down and land.I mean,how does he do that?,Ya can't do that with a helicoptor,so how the hell does a fly do that? Does he like counter invert his wings or what?. It's driving me crazy,I need the answer.

I had a similar experience with EX and after several mails certified of course.I finally sent them a last certified and explained that I could easily verify their CR was inacurate,but they were not paying me to do their job,so I fully intended to file a complaint with my state Attorney General as well as their States Attorney General for Fraud.The fraud being the way they seem to violate federal laws by refusing to do a complete and thoro investigation instead of the "computer says so" investigation,and apparently the word "fraud" in my letter set off every red flag in their office,LMAO,and within 15 days I got a semi clean credit report back from them and within another 15 days I got a clean report back from them.The only thing I need to go back on yet is an invalid address to which there now is no file attached to. I figured I would let the smoke clear a few months tho first and to re-assure myself my report will remain clean with them. I'm not going to get into all that was totally incorrect and easily provable with a 2nd grader investigation,but I was just tired of squeezing a lemon around with them using the info I have learned here,so at that point,I figured what do I have to loose.I know I'm right,so I'll just sic the state on em. Good Luck,Experian was my worst to deal with.

We recently had this issue in our Family.The girlfriends Mom passed and had no assets left,,,,,,thanks to some deadbeat kids of hers,so when we got a threat of a lawsuit in her mail against her regarding credit card debt,I sent them a copy of the death certificate anf let them know there were no assets and ,,,,,,oh,,,,good luck in their suit.
  10. To each their own I guess on Paypal and you all have some logical thoughts on them. I do alot of Ebay so in my case ( as much as I detest Payap and Ebay fees ) Paypal was the way to go. In my case as wel,when I was a wells Fargo Bank customer,my account was cleaned out by someone in another country.Literally cleaned out of several thousands of dollars. Wells Fargo made me literally fight them to get any of my money back,when their policy was clearly otherwise and the money was stolen from my account with them. They covered the loss after a few weeks and then later,turned me over to collections statting it was an overdraft,WTF?. In the end it was removed from my CR's and I never heard another word,BUT,to date,I have never had this problem with Paypal which is why I only use their debit card. Don't get me wrong.I love my local bank and credit union but refuse to ever use their debit card or anything that might get that info out there. I may be wrong but I do feel Paypal has a better security system than most banks. Just my opinion.
  11. I only use Paypal in all of my purchases as I have a Paypal debit card and personally have found Paypal safer than my previous bank. So when I got a new bank and then a credit union I declined the debit cards for both and instead stuck with my trusty ( never had any issues ) Paypal debit card. But,I also do alot of Ebay so when I sell I have that money in Paypal. Works great for me.

Someone else may have a better answer than I do,BUT,it has been my understanding thus far in my own situation that in my state SOL is 6 years and items fall off the CRA's at 7 years.In fact I recently got a statement of my credit from TU and it clearly showed the one last item I have is scheduled to fall off in Oct 12 and it's 183.00 so in my case it would be a waste of time and money no less,as it just went out of SOL and it has so much age on it anyway that it isn't hurting my credit score according to my bank.
  13. I don't know the laws about it,BUT,what if,since it is a short sale and her credit is obviously at risk,,what if,,,,,,,,,,,,,she would be grateful you or anyone else would want to buy the place in this economy?
  14. What State are you being sued in?.I ask because how service was rendered is different in different States.
  15. I watched a cockroach the size of a large dog steal the aluminum wheels right off a 911 Porsche in Florida once,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,and did it while the owner watched. There ain't nothing I left in Florida or with a Florsalamander worth going after,LMAO.
