hi, I opted out about 7 weeks ago. TU and EQ have it online that I am opted out. I check my CRAs almost daily because of the disputes. Today I noticed that before 8 a.m. my EX report has been pulled by portfolio recovery services and also search america. How is this possible?

Opting out doesn't prevent your report from being pulled when there is permissible purpose to do so. Or what mendelssohn said...Opting out just prevents your information from being sold to CA's that might not otherwise have it by CRA's. Think of monitoring your own credit except the CA's doing it instead. They pay for information and see changes and then if it looks favorable for collection they will.

if they already have your information that you owe a debt....or they own a debt of yours, they can pull. Opting out doesn't fix the issue of your information going to collection agencies and trying to collect.

Wow. This is very disheartening. Random people can pull your credit? Ohhhh I just got a letter from them saying I have a 14 yr old debt with them. They pulled my husbands credit too. If I put a security freeze on it will that work?

Random people cannot pull your credit. Companies that own your old debt can.

A 14-year old debt is nothing to be disheartened about. Heck, many on here would consider it an opportunity. By the time it gets that old, it is likely a bottom-feeder with little documentation ready to stumble all over their own tongues and keyboards with violations. Read up and know exactly what your rights are and what they are absolutely NOT allowed to do with a debt that old and what YOU should do next. Most importantly, do not talk to them on the phone, do not give them any information, and do not pay them a penny.

Search America is a skip-tracer/data compiler/verifier likely working for one of the collection agencies you owe money to try to find where you are now and what state your credit is in and whether you are in a position to pay.

Hopefully these are soft pulls, as Search America is known to do hard pulls, and do them regularly enough to cause you grief. I guess they figure if they can't get in touch with you, they will hard pull you every other month until you call them screaming WTF?

Wow thank you for all the help. Portfolio recovery is Sears original collection agency. Smh. They said (in the letter) I have until the 21 to contact them. I just got it and I have a week? And it's in my maiden name. I've been married for 12 yrs. I deleted my maiden name and spouse and old addresses from all reports a couple of months ago. Do I do a dv letter by certified mail?

Hi, If you got a dunning letter from Portfolio Recovery, The FDCPA gives you thirty days to file a dispute. Once the dispute is sent CRRM, The protections to you as a consumer commence. Texas is the only state a dispute can be filed at any time and it has to be answered within a thirty day window. A CA as defined by the FDCPA doesn't have to return an answer to your letter but they must mark the negative trade line as disputed. Your account is way passed the state statute of limitations. Send them a FOAD letter.

Most importantly, do not talk to them on the phone,

Normally I would agree with this, but with a debt this old talking to them can be profitable. Just make sure you don't make any statements about owing the debt, concentrate on asking questions like "What will happen to me if I don't pay?"

Oh, and make sure you record the call.

The point of the letter is it cost them almost nothing to buy the debt, and under fifty cents for a stamp.

And some people actually PAY 15- year old debts to people who mail them letters, just as people send money to that Nigerian guy holding the $5M for you.

Yes, maybe they get 1/1000 people they send letters to, but when it is costing nothing, everyone you get to pay is free money.

And they HAVE to tell you those things as they are barred by law from suing or putting it in your reports..

My next situation is, there is a 14 year old debt I have with a school, not a student loan. 2 years ago the school added a bogus charge to reage the debt, I believe. It is still with the original creditor and they still have a relationship. They added a 200 dollar charge, and the old charges are 4400. Now they are on my credit for 4600 and are acting like this is legit. They are sending nasty letters, and report it almost every month
