I thought I will try and keep them all in one thread. So first the background:

From now on I will post all updates to both lawsuits here in this thread :lol:

 

Experian/RC Willey:

 

RC Willey has updated the TLs to about 90% accurate. I offered to drop them from the lawsuit, but they declined and said that "counsel" will be contacting me shortly. Haven't heard anything from them since.

 

Experian's councel Mark called today. Ironically enough he is in the same building as Mr. Tony Love - who I settled with about a year ago for kinda the same thing except different CRA. Mark said he knew Tony, perhaps they will talk over the water cooler and figure out that I won't back down, and just easier to settle with me soon.

 

He said he is going to remove to Federal Court, I said that was good and saves me the process of amending my complaint to reflect the correct court (I copied and pasted Fed court info - duh). He then asked for a summary of what I thought this case was about - I gave it. To which at the end he pauses and says, "You seem to know a lot about the law, do you happen to have a legal background?" That is when I told him that I just happen to be a very educated consumer and have already previously been through this. He asked how that case turned out, I said, "we settled out of court when both sides finally came to an understanding of what it would take to resolve the issue." He said he would take my information to Experian to see where they stand on the issues and what we can do to resolve it.

 

He also asked for a copy of all my exhibits - so tomorrow I will be sending off copies of all 31 pieces of exhibits. Sorry I didn't update the complaint in the original thread to what it is today, maybe when I get some time I will do that.

 

Just wanted to update.

You have 'em against the ropes!!! Keep sockin' it to 'em. Bet he was shocked to find such an educated consumer. They better be prepared: there's a lot of us out there and our numbers are growing daily. Know thy enemy--in this case--know the credit laws and how it applies to your case.

 

There's a new kind of consumer out there--the Credit Warrior. And you certainly qualify. Good Luck!!!

Pulled reports today:

 

RC Willey originally had two tradelines per report, with numerous lates, incorrect status, and other inaccuate information.

 

Today, they have all been updated to "closed by consumer, pays as agreed", and two of the six tradelines have been deleted - EX and TU have deleted off second tradeline, I suspect EQ will be next. Interesting what they are doing, oh and it will be interesting to see how they respond to Experian removing the complaint to Federal Court.

Update:

 

Experian/RC Willey:

 

Jointly filed Notice of Removal. Just as they said they would, so now that case is bumped up to Federal Court. Fine with me :D They have 4 more days to also file their answers.

 

Dell:

 

Just called the court today and they filed their answer on the 20th, so I expect to get that in the mail today.
