I just did it. I questioned it let them know it was illegal then paid it to get my truck out and then disputed the charge with Chase Mastercard got my money back and they were informed about breaking the law as well as their merchant agreement

There is a liquor store here that charges extra on everything paid w/a credit card. I just pay with cash or my debit card.

Depends on the situation. If I'm just desparate to pay for my merchandise and get the heck out of the store, yeah.

That last reason is probably the one that most people would cite. In a fast moving world most people don't want to argue over such things. This is especially true if you have already gone to several stores looking for something and only that one store had what you were looking for. Even more true if its 104 degrees out and you just want to get home.

The convenience store downstairs has that fee for minimum transaction - so I don't use my debit card there (it doesn't matter if its credit or debit if it's under 5.00 they charge).

just tell them no, that i will report them to the appropriate card issuer and buy somewhere else

Okay, I'm new here, but do you mean to tell me that the "fee" added to my card at Taco Bell/McDonalds/ is "illegal?" Please let me know so I can get my money back soon!!!!!

it's ILLEGAL if you pay by credit card. if you pay by debit card, then the fee is LEGAL.

THEY CAN NOT ADD A FEE TO ANY VISA/MASTERCARD/AMERICAN EXPRESS

The exception is if you use the check/debit card as "DEBIT" instad of "CREDIT". Credit is on the Visa/MC network... debit is not.

McDonald's/Taco Bell should not add a fee... if they do, dispute it, report them, and don't pay it.

Merchants can't have a minimum purchase requirement or a fee added to transcations (even if under an ammout)

IF I WANT TO CHARGE $0.30 PACK OF GUM TO MY VISA THEY MUST ACCEPT IT WITHOUT A FEE! (And if the card is signed without additional ID too)!![/b]

i'm an "argue, pay the fee, report the merchant" kind of guy. last month i went ahead and paid the fee for the food, and today, just got a letter from Amex saying "We are pleased to report that, because you are a valued American Express® Cardmember, we have issued a permanent credit for $6.47, which will appear on the upcoming statement. Therefore, we have removed the disputed amount from suspense and reapplied it to your account, which will reflect on an upcoming statement." I wonder if Amex actually talked to the merchant about their wrong practice and did not pay them or if the amount was small emough that they just decided to give me the credit on their behalf.

Mabye American Express is doing the right thing and fining merchants or doing a chargeback when there are fees added.
