Since I'm in the beginning stages of dealing with LVNV, and I don't trust them one iota, I figured I would be proactive and search my local courts for any cases filed against me. Thank goodness, nothing showed up with my name on it, but I did find 1,833 current and open cases in my county alone filed with LVNV as the plaintiff. I had to limit the search to my county only, as the list for the whole state was too large. I wonder how many of these people even know they are being sued, or what it is even for, or that they have rights to fight with.

 

I guess I'll have to do this search every week to make sure they don't try to slip something past me.

I couldn't tell, only that they were open and awaiting appearances. It wouldn't return the list if I didn't limit it to open cases only, so I can only imagine how many there have been in just the past year.

 

I'm waiting on their response to my DV letters - I can't wait to see their "proof".

Since this is public record, i would use it aganist them in the discovery phase.

 

How can you ensure everything on my account is accurate, when you have 1800 others on file also?

 

Do you review ALL those?

 

If so, Provide the name, and title and position of the person who did such.

 

What steps did they take to ensure my account was not intercepted with any others?

 

Do you have a policy in place for this?

 

Where is it?

 

When was it created?

how exactly does one go about searching there local court for this info? Is it available online or physically at the court house? What section would it be in at the local courthouse?

It is accessible online for many cities/counties/states. Just find the public records section of the web site, search for civil cases and see what comes up.

Wow! I just pulled up Case.net for MO and found 8010!

 

There's no way they have accurate info on all these cases if I were going to court with them I'd find as many as I could you'd have 10K easliy and ask them how they keep track of that many.

I looked online at my county's court site (in Ohio), and there were too many to show up w/out narrowing the search! Out of all of the ones I did see (about 80 or so), all but 1 were granted default judgements. Lucky bastids! The lone 1 filed countersuit against TU and LVNV and wouldn't ya know, that case was dismissed!

 

I have to deal with them the end of Dec :D in court.

LVNV in Philadelphia county is 500+ cases, some defaulted, 2007 cases are mostly waiting for hearing to be scheduled, and others say it was dismissed without prejudice or precipe....whatever it is, I looked it up yesterday. I hope they stay away from me!

I've received two Dunning letters from LVNV True Logic, and Capital Management about a 'debt' who's origin I don't have a clue.

 

My last DV to Capital advised them I had become aware of their scam.

 

Resurgent replied to the DV to Capital (proving my accusation!) that they had purchased the debt from OCI/Gulf credit, whom I vaguely remember DVing a long time ago.

 

It seems a 3rd grader could see through this scam. They don't even seem to care much about denying it.

 

I'm amazed courts don't hold LVNV in contempt for fraudulently trying to use it to avoid FDCPA.

 

I'm replying to the DV to both Capital and Resurgent with a cease and desist demand, advising them that their letters constitute 'continued collection activity' after failure to validate. I'm advising them the

violations they've accrued for that plus, deceptive collection practices.

 

I'm giving them the total $$$ they owe me so far, and warning them that I am documenting their violations as preparation to submit to legal council at which time, 'I'll sell their debt!'

 

(I've done it before & I'm serious as a heart attack.)

I decided to check out my county just to see. And yes, both Midland and LVNV are there. Not for me. My name doesn't show up at all. I am noticing that you have to have a debt of at least around $1,500 before they will sue you in court. ($1,386 was the smallest amount I saw.) Lucky for me the largest I have is a medical bill. Normally they don't sue for medical bills that are going to fall off your report in 7 months. The SOL is gone on that anyways.

Dude, there's something beautiful about the idea that a CA could end up owing you money, and that you could sell that debt to another CA...

 

What I mean is that the more violations I've documented in dollars - the more interesting the case is for a lawyer.

 

My program for fighting them is to accrue violations, and add them to their 'invoice'. Very similar to the procedure that they're using on us. I like it because, it's something the little s*its can well understand!

 

LVNV's got to hand me more violations before I have the 'buying power' for a good lawyer.

At this point, I've only receievd a few letters from them. They havn't touched my CRA's.

 

At this point in the fight, It's all 'fun and games'!

One thing people are failing to realize is that the courts DO make a ton of money from this process, so they absolutely LOVE JDBs and CAs like Midland and LVNV. Imagine the cost to file each of those suits, which the court profits from even if they're dismissed (with or without prejudice).

 

I was at the courthouse last week checking on my judgment status, and I saw that civil "collections" court was in session. I asked one of the attorneys which one worked for AFNI, and surprisingly one guy said "I do." I told him I can't wait until they sue me, because he'll see me again and I hope he brings a check with me. He just shrugged, and then said "the last few guys settled, you will too." Unbelievable.

 

If you get a chance, take a day off of work and sit in on civil court when dockets have suits from CAs and JDBs. You'll see more collusion between the courts and the CAs than you can imagine -- and a lot of no-shows who were properly served.

You need to watch them like a hawk though, since my original debt was reported as around $900, then 1200, then in Januar they upped it to 1700. They will "add" what ever they can to try to make it worth their while to take you to court it seems. Also, medical accounts do not fall under the same rules as regular accounts. If the bill is from a hospital that accepts any kind government asistance (medicaid, medicare) there is no SOL on the debt. Montgomery County Pa 456 cases....

 

Hi Scorpio...I've been checking the same court dockets. Since we seem to live in the same area :) , are there any other dockets I should be checking? My stuff is SOL, but I'm not taking that fact for granted and want to "keep watch". Especially since L V NV is one of my current aggravations. Thanks in advance and hope you're keeping warm!

The same as you noted in your post....way upper NW corner. Grew up in the county seat but now live a peaceful life in the woods lol. And ftr, freezing my flowers off today in this storm.
