Since the right of charge back is granted by Federal law(15 USC §§ 1666, 1666 i, and 1640( e ) and in 12 CFR §§ 226.12( c ) and 226.13) (and in many cases State law as well) nothing they put in the contract can preempt that. I'd also expect that unless they added a clause of severability to their terms you could expect the entire contract to be thrown out once that section was found to be illegal. So no they can't take away your right to chargeback and while they might be able to sue for the $1000 if you filed a chargeback and lost I'd really doubt it. Of course I'm not a lawyer and this is not legal advice its just my slightly educated opinion.
  3. The Asus doesn't run on the full version of Windows XP - it's almost twice as heavy as the Sony and it's got no hard drive (did I miss something there?). If you want a keyboard, you've GOT to purchase an additional one. It's essentially a PDA. The Asus Runs XP Tablet PC edition, thats full XP Pro(Yes, even domain support), with SP2 and additional handwriting recognition and other tablet format tools. It weighs 1.83lbs, compared with Sony's 1.2 so it is heavier, but that larger screen will allow you to actually use the onscreen keyboard so you won't need an additional one, it also is very readable and its network/AV ports arebuilt in, where the Sony uses a dongle (which while included gives you one more thing to carry). The Asus ships with a 60GB hard drive, so it also has more storage than the Sony. Its main drawbacks are the smaller amount of RAM (768MB instead of 1GB) and slower processor (900MHz, vs 1.2GHz). I looked at the Samsung Q1 - the screen is unimpressive, it's heavier than the Sony, and like the Asus, you MUST purchase a keyboard. The new Q1 is also only two or three hundred dollars cheaper than the Sony, and doesn't offer an extended life battery. I've yet to physically see the Samsung so I'll trust your assessment of the screen, but again it ships with Tablet PC edition, so the onscreen keyboard is very useable I realize the Sony keyboard isn't ideal, but it's THERE, and doesn't require me to carry an additional one. As an added note, with the bluetooth capability in any of these devices you should be able to connect it with your bluetooth enabled cell to access Sprint's high speed data network. You'll have to set up the plan with Sprint and may need a new phone, but at least you won't have to use different carriers or settle for slow speeds with Cingular.

While I'd hate to see good people like GEORGE out of work I'd still love to see Wally World go the way of Monkey Wards, Service Merchandise and the long list of other retailers who failed to adapt. Seems to me they are surviving in spite of their efforts rather than because of them, and thats a bad business model.

Me, I'd go with this Asus.. for two reasons. #1 I don't pay the $200 it says Sony on it fee and #2 For half the price I can live without a too small to really use keyboard(Its a tablet anyway.. you don't need a keyboard), and love the included GPS. But thats just my vote. Samsung has a similar product I'd consider as well, its also half the price of the Sony.
  7. name em... its hard for the business to nip issues in the bud if they don't know who caused the problem. Plus it saves the rest of the staff from a generic, "Someone did this and we can't do that" lecture.
  8. I have even more sage advice. Don't buy Gift cards at all. Take the $$$ you'd have applied to that one store card, and give it as cash. Cash has no fees, its nealry impossible to steal without physically taking it, and its the perfect gift for any occassion. Sure Uncle Earl, might love sporting goods, but that gift card to Sports Authority won't help him if REI is the only place that sells what he wants. Plus, theres no more leaving 62 cents on the card because it was for $50 and you only spent $49.38 Heck cash is a much better gift... even people like GEORGE who've gone to a cashless lifestyle can deposit it in their bank account and use it as they see fit.

  11. hmm $250 in 04... hell by now they ought to be about $34.99, being as the technological parts are surely obsolete and theres no way they're in style anymore either
  12. The "speed" of the slide will be the determining factor. So, if you only have a 5foot deep pool, you'll be limited to slower slides, than if you have more depth. I wouldn't consider a slide into less than 5 feet, though you can find some that are rated for use in as little as 3.5'. If you want a "fast" slide you'll need more depth. A competent pool shop should have better guidelines for specific slides.
  13. Time for a dead horse award: And my philosophy on the reciept checkers. Keep on walking.. they aren't going to chase you. If you want to stop and dig out the reciept and waste your time, go for it but I have better things to do.
  14. I love my Solar Powered snow blower. It takes no effort on my part... just wait 2 days and the snow is gone...
