  1. Sorry for dredging up such an old post, but I got this same type of phone call from DRS today. Did they ever send a 1099?
  2. So would it be better to have 7 cards with a 1000 limit then, or even 14 cards with a 500 limit?
  3. So do credit cards. For those that can, they will switch to credit cards. For others that like debit cards & those that don't want credit cards. They will switch to a different bank, prepaid debit or cash or a combo. Here is where I wouldn't use my debit card. I would use cash Fancy restaurants Pay at the pump Inside certain convenience stores unless I have enough money in my checking. Places I use them. Google checkout Paypal grocery stores Trusted online websites. Dollar stores. The dollar stores, I wouldn't use a credit card there it could be considered a red flag and may cause you credit card to be canceled. Department stores and other places I may have forgot to mention. I'm curious, would you mind sharing your reasoning for these?
  4. I am weighing my options and trying to decide what to do as far as obtaining secured credit cards. Which option has a more positive impact on credit scores with the goal being a higher fico: 1. one cc with a 7000 limit 2. two cc with a 3500 limit each would your answer be different if the single cc in option 1 were utilized to ~60% whereas in option 2 one of the two cc is maxed out? Discuss...
  5. Public Savings Bank recently failed and was acquired by Capital Bank. They have introduced an Annual Fee of $50 and a monthly 'Statement Fee' of $3.00. early in my relationship with PSB I learned that they do not like it when you PIF. They will hold payments over $100 for 10 days, that earned me a late payment fee...but they did not put a late on my CR. I will most likely be moving away from PSB as soon as I choose a new secured card. ___ Applied Bank charges a $50 fee for the first year (start-up fee I guess) and $9.95 per month maintenance fee after the first year ($119 per year). Customer care is only open during "business hours" 9:00 AM till 6:00 PM Eastern if I remember correctly. I will most likely be moving away from them soon too.

The Eleventh Circuit Maxcess. Inc. v. Lucent Technologies. Inc., 433 F.3d 1337 (11 th Cir. 2005) applied Florida law in upholding a choice of law provision in a contract. The Comt held under Florida law courts will enforce choice-of-law provisions U11less the law ofthe chosen forum contravenes strong public policy. The Florida Supreme Court in Mazzoni Farms. Inc. v. E.I. Dupont De Nemours & Co.. 761 So. 2d 306,311 (Fla. 2000) upheld a choice oflaw provision which released the defendant from all claims, including fraud claims. The Supreme Comt held "while we both recognize and reaffinn Florida's policy disfavoring fraudulent conduct, we are mindful ofthe rigorous standard employed in detennining whether to invalidate choice-of-law provisions. Accordingly, we hold that enforcement of the choice-of-law provision is not so obnoxious to Florida public policy as to render it U11enforceable." The Court also placed the bmden on party seeking to avoid enforcement of the choice of law provision to show that the foreig1l law contravenes public policy of the forum jmisdiction. See also Burroughs Corp. v. Suntogs ofMiami. Inc., 472 So. 2d 1166, 1167-69 (Fla. 1985)(contractual provision shortening the period oftime for filing a suit was not contrary to a strong public policy); Credigv Receivables. Inc. v. Hinte; Circuit Court, Florida Fomth Judicial Circuit, Duval County, Florida signed by Judge Charles w. Arnold, JI. on November 8, 2007. - There are some states with much longer SOL on CC accounts (Rhode Island is 10 years, MA is 6 years), so check on that before you act.
  7. I usually make my C&D a limited C&D in the DV letter... something like "...cease communicating except when required by law or to provide the information I requested..." etc.
  8. How would this apply if JDB mailed notice to old address (lived at previously)? What about an incorrect address(never lived at)?
  9. I got the rate increase email today, called in and got the 9.95 for 6 months deal... awesome! It looks like they used a special toll free number for this fee increase, because it doesn't match their regular toll free number listed on the site.
  10. I recently received a medical invoice from {a well known lab} for blood tests that my doctor ordered. I did not know I was going to be billed for this, the doctor never mentioned that it would cost extra, or that it was an extra or optional service. Do I have to pay this? The insurance paid $100 and the lab adjusted $1,000. The amount due is almost $400. I feel like I should not have to pay this because I never knew that I was going to be charged. The nurse simply said "the doctor wants me to draw some blood", to which I replied "oh, okay". I was never told that they were going to send blood to an outside lab, or that I would be charged extra for the privilege. What should I do?

Are there any creative ways to 'unload' a home that you can't 'afford' anymore? issues: the housing market is soft (buyers market; avg 180+ days on market) the home is in a new subdivision that is still being built in phase 4 and 5 plus other new subdivisions nearby the market value doesn't cover the loan payoff plus closing costs owner does not want to be a 'long distance landlord' over 1200 miles away any ideas are appreciated
