Just got a call from these guys regarding a PDL my wife took out in 2005. I was told they are an internet company and DO NOT send out dunning letters or verify this debt other than email. They have called the house some 30 times in the past week and we live in Texas.

 

The loan was taken out in early 05.

 

They refused to give me their mailing address. How do I figure out how to respond to these people. We have had NO information from them and they refuse to give it out.

 

The phone number is this - 800-594-3426. I have tried googling it and all I get is either 800 numbers or an email address.

 

Anyone have any ideas.

They told me they DO NOT send things in the mail. This is what is throwing me off? I need a physical address. I guess its time to delve into the TX SOS to see if they are registered.

Here is an address that I got from another forum. I have searched the OCCC in Texas with NO information on this company that lists either a bond or license to do business in Texas.

Miami, OK 743555

 

Unfortunately the SOS web search is currently down and no searches were conducted. Apparently this company is not licensed to do business in ANY State (from my reading and understanding)

 

How do I make the salamanders go away.

 

CENTEX or other GURU's... I need some outside the box thinking here, or at least kick me in the right direction.

FOFF AND DIE letter.

 

While I really like your way of thinking, I cannot confirm that this address is even theirs. What I am going to do is call them in the morning with my handy dandy tape recording device and get them on a few violations. They do not have any of our current banking information and I seriously doubt that they will try to sue or send it to collections. Its been 4 years and the SOL is upon this debt. I will wait for further input on this and want to get the State of Texas involved.

Keep in mind they may not be subject to the FDCPA.

 

NO Federal laws here....TX law has MORE teeth. This is why I am waiting on them to violate TX law.

Phony Debt Collectors Harassing Consumers Nationwide

Claiming to call about payday loans

 

 

Phony debt collectors are calling consumers nationwide and claiming that they have defaulted on a payday loan and will be arrested if they don’t pay immediately, warns a national alert from the Better Business Bureau system. Claiming to be lawyers, the scammers say they are with the “Financial Accountability Association†or the “Federal Legislation of Unsecured Loans†and are equipped with a disconcerting amount of personal information about their potential victims.

 

“Because the scammers have so much information about potential victims, BBB is concerned that this may be the result of a data breach,†said Jeannette Kopko, BBB Dallas spokesperson. “Thousands of people may have had their personal information compromised, and given the scammers’ tactics, it appears that those who have previously used payday loan services could be particularly at risk.â€

 

According to reports received by BBB and posted online, the scammers accuse the victim of defaulting on a payday loan and claim they are being sued. The phony debt collector threatens that, if the victim doesn’t pay as much as $1,000 immediately via wire or by providing bank account or credit card numbers, he or she will be arrested and extradited to California within the hour to stand trial. The scammers often have the victim’s Social Security, old bank account numbers or driver’s license numbers as well as home addresses, employer information and even the names of personal friends and professional references.

 

BBB offers the following advice to consumers if they receive a suspicious telephone call about an outstanding debt:

 

Ask the debt collector to provide official documentation which substantiates the debt.

Do not provide or confirm any bank account, credit card or other personal information over the phone until you have confirmed the legitimacy of the call.

File a complaint with the Federal Trade Commission online if the caller is abusive, uses threats or otherwise violates federal telemarketing laws.

File a complaint with BBB online if you believe a debt collector is trying to scam you.

According to complaints online, phone numbers that the scammers are calling from include: 949-468-5107, 415-200-0274, 415-200-0274, 213-784-5745, 408-715-1614 and many others.

Guys,

 

I know I am in Texas and this is supposedly an "OC". Where do I start with these guys? What are the steps for an OC to verify this debt?

 

I know they do not need to send out a dunning letter - correct?

 

They do have to send an itemized accounting of this debt - correct? (they said they DO NOT use USPS, only email. What are the legal ramifications on this (would this hold up in a court of law)

 

Can I ask for a written signed contract?

 

I really need some help on this one - Am lost :aggressive::blush2:

can someone explain to me why debtconsolidationcare asks for all kinds of personal info on its web page? is it a forum or a lead generator? thanks.

 

It is a forum, to help people get out of debt, and has a debt conslidation company that's it's affiliated with (I think) you don't have to sign up and give them and give them your info.. that's only if your interested. There is an option underneth it to click to sign up for the forum without having to sign up for the free consultation with debt conslidation company.

 

But as others stated you can surf the form without signing up for anything/username etc

 

As to the OP, Contact TX DFI as your first step they will go away REAL quick. They are highly illegal.

 

I'm assuming you stopped all payments/closed checking account that it's affliated with? Also I know TX is a Non-garnishment state, but I'd also type up a Wage revocation letter just to be on the safe side.

I screwed up the address so he might think I was actually trying to mail a payment. At the very end of the call he sounds like he knows I'm just phishing for info.

It would help to know which website was used for the loan...at least then you can back-trace to the loan originator and begin sifting through the domain registrations. There are too many listings for united now and there is no way to tell which one was in use back when the loan originated...
