... your purchase is less than $5.00. They called it a service charge.

I wouldn't think this is legal.

Most states it is legal, some states it's not. Regardless, it is a violation of credit card company policy. Well, ummm... most credit cards.

California, also, plus a handful of others that I can't remember off the top of my head. There's a list of them floating around here somewhere.

Yup...it is a crime in Florida...it's a violation of section 501.0117 of the Florida Statutes...

501.0117 Credit cards; transactions in which seller or lessor prohibited from imposing surcharge; penalty.--

(1) A seller or lessor in a sales or lease transaction may not impose a surcharge on the buyer or lessee for electing to use a credit card in lieu of payment by cash, check, or similar means, if the seller or lessor accepts payment by credit card. A surcharge is any additional amount imposed at the time of a sale or lease transaction by the seller or lessor that increases the charge to the buyer or lessee for the privilege of using a credit card to make payment. Charges imposed pursuant to approved state or federal tariffs are not considered to be a surcharge, and charges made under such tariffs are exempt from this section. The term "credit card" includes those cards for which unpaid balances are payable on demand. This section does not apply to the offering of a discount for the purpose of inducing payment by cash, check, or other means not involving the use of a credit card, if the discount is offered to all prospective customers.

(2) A person who violates the provisions of subsection (1) is guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

Violation of the statute carries a fine of up to $500 per offense.

my dry cleaner is always claiming my orders are too small for CC payment. i tell him to go ahead and up the amount to what he says is his minimum dollar amount. then i call the CC copmpany to dispute the upcharge (but not the actual charge for dry cleaning). each time, the CC comps me the entire amount.

now when i try to pay with CC, he adds the amount to my next order so i pay for several orders at once.

That's the way to do business. Instead of whining because the big places have it so much easier, you take a problem and create a solution that works for everyone. I doubt if you mind not paying for your cleaning until next time, and your cleaner saves on processing fees. Win-win!

Our Taco Bell added $0.79 to my order without even telling me. Next time when I drove through it said they charge this for ATM cards, but I paid with a CC. I didn't have time to argue, but I will not go there again

Its amazing that they charge at all for debit card transactions. The increased revenues for getting more sales way outweighs the cost of the charge they receive for processing a debit transaction. Pretty much the whole $0.79 was pure profit.

I never use debit... always credit so it goes via the VISA network.

start free plug----

I also only use my debit card as credit - I joined BofA's keep the change program. They round up to the nearest dollar on the transaction and that goes to savings. Right now they're matching the amounts up to a cumlative total of $250! Basically free money!

end free plug

If you have BofA checking/savings, its a pretty good deal.

It's my understanding that many of the debit surcharges are actually from the third-party company that owns and maintains the machine. For the business, it's a win-win. They get their normal cash sales, and they get more sales from the people who use the debit card (there are plenty of people who will pay these fees without giving it a second thought). And, they don't have to pay to maintain the network. It's literally a zero-cost for them. From their standpoint it's great... increased sales and zero cost.

Have not been to taco bell in a long time. They only take ATM (which they seem very proud of), and I would guess there's a surcharge.

Taco Del Mar, on the other hand, takes CCs and has better food. Win win, for everyone except taco bell. :yahoo:
