CBCS called my cell phone today and left a message to call them. Didn't say who they where but I googled the number and that's who came up. I sent them a DV which they signed for a July 3rd, as of yesterday (July 10) none of my CRs are reporting the account as disputed.

 

I've saved the voicemail from them, isn't tis a violation for trying to collect before the validate the debt?

I meant to ask if I should call them and record it, hoping to get more violations. I have no desire to sue them but I know the more I have against them the better the chances of getting it removed.

Maybe. But you should have answered the call to consummate the infringement. (I'm a firm believer in letting people hang themselves on the record.) What was the text of your DV?

Thank you very much for your replies. My letter was this one. I know they will call back, should I answer and if I do should I record it? Again thank you for the help.

This letter is being sent to you because of the information being reported on my credit reports. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (:angry: that your claim is disputed and validation is requested.

 

This is NOT a request for “verification†or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

 

Please provide me with the following:

 

 

What the money you say I owe is for;

Explain and show me how you calculated what you say I owe;

Provide me with copies of any papers that show I agreed to pay what you say I owe;

Provide a verification or copy of any judgment if applicable;

Identify the original creditor;

Show me that you are licensed to collect in my state

Provide me with your license numbers and Registered Agent

 

At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau’s (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:

 

Violation of the Fair Credit Reporting Act

Violation of the Fair Debt Collection Practices Act

Defamation of Character

If your offices are able to provide the proper documentation as requested in the following Declaration, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist.

 

Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

 

If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.

 

I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS.

 

It would be advisable that you assure that your records are in order before I am forced to take legal action. This is an attempt to correct your records, any information obtained shall be used for that purpose.

You have at the minimum one violation. You requested in writing that they stop calling in reference to the debt.

 

If and when you receive a response, they could put the default mini-miranda about attempting to collect a debt, and that would be another violation, since they hadnt validated the debt before continuing collection efforts.

 

I would call your phone company, get a printout showing they called on that date, send that, a copy of your green card, and a letter stating they violated the law, should get a delete.

Ok, I thought I had them on that. I have my cell phone set so I can record easily. If they call in the next couple of days, I will record the call. I'm pretty much going to play dumb and I won't give them any info. If I do get it recorded I'll put the recording up here so you all can have fun with it.

Did I mention this was a lot of fun as well as productive. Ok, so today I haven't received any calls from CBCS but I did get a letter from my DV. Of course it was on Verizon letterhead saying they didn't have to vailidate because they're the OC. So, I called the Verizon collection office that originally told me to contact CBCS and that they where the ones reporting on the CRA's. I called and immediately told the guy I was recording the call, which I was, and asked if it was them collecting it and if they had sent the letter to me. He stated that it wasn't them and that my account was with CBCS and that Verizon hadn't sent me anything.

 

My thinking is that I should just go ahead and send an ITs letter and be done with it. Anyone have any thoughts to the contrary?

 

Also, I did this by mistake but this is my only derog that is in the sol(I know I know) but if I can get CBCS to delete this should I call Verizon and pay the 135 so I don't have to worry about someone else reporting on the my cr?

another violation..now their impersonating other companies...

 

i suggest you contact the higher ups at verizon and let them know..that some one is using their name..and pretending to be verizon....correct me if i'm wrong but i thing that is big time federal charges...

Well, I'm at a loss now. I just filed a complaint with the FTC and the Ohio AG. Here's my problem, I received the letter back today saying that they where Verizon blah blah blah. Does anyone know for sure who's po box that is? I spoke to Verizon today and they said it was theres and it looks like it really is and if it is that means there was no way for CBCS to validate it. ARGHHHHH

Here's something else, I thought but couldn't find that someone had their Bellsouth collections with the same po box. If that's the case then I know that I have them in a lie. If anyone can help I would appreciate it. Otherwise I'm going to have to send another DV out to CBCS.

Why send a ITS letter just file a small claims send this letter with it.

 

 

To whom it may concern.

 

This letter is in regards to the enclosed small claims lawsuit which I have filed, due to your company violating my rights under the Fair Debt Collection Act practices Act (the FDCPA) As you know the FDCPA states that when a consumer request validation IE disputes a debt that under section 807 paragraph (8) you are to mark said account in dispute on my credit report. On xyz date your company signed for a certified letter (see attached) requesting full and complete validation per the FDCPA As of todayXYZ date this has not been done. I also asked that all communication be by mail on XYZ date I recieved a phone call from your company (phone number)(add FDCPA section violated ) I therefore have no choice but to invoke my rights under the FDCPA and therefore bring action against your company.

But in lieu of going to trail I would be willing to settle this matter and withdraw my complaint if you would like to settle. If you are interested please contact me at my email address below. I am sure that we can work out a settlement that will beneficial to both of us. I look forward to hearing from you.

Ok, here is what my next step has been. I stopped by the post office and filled out a form that is a request for the name of a po box. Basically I want to make sure that the po box I sent the DV to is indeed CBCS. I have my worries because when I spoke to Verizon yesterday the girl told me what letter her department sent out and on what date. It was exactly the letter I had received. If the request comes back and it is CBCS's po box, I'm going to file suit against them and Verizon. If it comes back as Verizons then I will send another DV to an address that I know is CBCS's.

What a great morning I've had! Ok, just so all of you will know when you have a po box for a business you can go down to the Post office and fill out a form and they can verify who the company is that owns the PO Box.

 

So this morning I go down to my local Post office and have the form filled out, well the lady that has helped me send a lot of my certified letters was there and she gave me a number to call and told me what to say. I basically called the person that handles the po boxes for that zip code. He stated that the po box 165018 is marked CBCS/Verizon, that CBCS owns the box and picks up all of the mail in the box. They basically have Verizon on it because they get so much mail marked Verizon because if you have a collection from Verizon more than likely it's with this po box. ON my eq cr it's the E town st address but that's still CBCS. Small claims here I come!!!!!!!!!!!!!!!!!!!!!!!!

it's a "special" box that CBCS has for Verizon accounts.

 

 

I'd personally get an attorney (if you were in Illinois I could reccomend one) and nail them in Federal. Class action would be the way to go to make them stop this

i got them removed. i wrote to equifax an honest letter saying that this is CBCS and not verizon, provided facts and they removed.

just do not sound too legal sound like a honest guy and equifax will remove it

Ok, so here's an update on this account. I've filed a complaint with the AG of Ohio and Tx and with the FTC. I just got off of the phone with Verizon and spoke to a supervisor, he stated that the po box I sent my DV to was Verizons and I told him that MR Hinkel of the USPS said it was CBCS's and since he was the supervisor over the po boxes in that zip code he would probably know. The supervisor told me that guy was wrong. LOL

 

So, on July 3rd they signed for it. (CBCS or Verizon) I sent it addressed to CBCS and to the po box on my credit report which is confirmed by the USPS to be CBCS. On July 5th I received a letter with Verizon letterhead and said they didn't have to validate because they where the OC. When I called Verizon today they said they're the ones that got the letter and responded to it. Problem is, I didn't address it to them and I sent it to an address owned by CBCS. So, I just got done with a phone call to the United States Postal Inspection Office(the law enforcement side of the USPS) and we are going to go after Verizon for mail fraud since they opened and responded to a letter not addressed to them and not at their address.(I don't think they received it nor did they respond to it, CBCS did but since Verizon is insisting they did this is how I will go about it)lolololololololololol

The USPS will go "midevil" on their backsides, if you know what I mean. I can't wait to see what happens they they go after them. Mail fraud is very, very serious!
