If I dispute the info with the court, do they have to supply validation/verification the same as any other credit report furnisher? I am talking about a dismissed BK being reported on my reports.

Nope, they aren't the one furnishing the information to the CRA's. Reporting is not required, the courts don't furnish information, they provide ACCESS to public records -- that's it.

This is kinda funny, since I'm slap-happy today, would be frustrating under other circumstances.

THAT'S where the answers are, still are, if you would please read that thread, I know it's long, but you'll see right where you are and where you are heading and the documentation you need to get there.

 

The whole point of the thread is that the court is not the furnisher.

 

Here's the short version, now, follow your own thinking, you are so close, you've the right to dispute directly with the furnisher, yes?

 

The CRA's say the court is the furnisher, yes?

 

The CRA's are required to disclose the furnisher of information to us so we can dispute with the furnisher directly, yes?

 

What do you think would happen if you sent a letter to the court saying the CRA's advised me to dispute this directly with you as the furnisher of information, please advise of your process for doing so -- or something similar? or what is the process for disputing the accuracy of the information you are furnishing to the CRA's?

 

Hopefully, you'll end up with a letter from the court saying they don't furnish information (they don't respond to verification requests either), they only make the information available.

 

There's your deletion.

I have been waiting to reply to this one to read (and in this case re-read for the third time) the long thread.

 

Having you give me the short version in this post might have made that light bulb go off this time.

 

So, first, I should send a PR to the CRA's in regards to their verification of the BK.

 

Question about this. From many posts I have read here, they always reply "If you question the results of our investigation, then you may want to contact the data furnisher directly".

 

I assume that this is the letter I should wait for.

 

Then contact the courts stating I was told to contact them from the credit bureaus, outlining as you state above, to please tell me their process for disputing the accurracy of the information they are supplying to the CRA's. Making it very obvious to them the CRA's are stating they verified the information as correct with them.

 

Am I on the right track now?

Yep...you're on the right track...you WILL receive that letter from the CRAs (although that doesn't really cut it as a response to a PR), and then write to the courts exactly as you stated above...do NOT CALL THEM!!!! Don't put your phone number in the letter...get it ALL in writing

Does the initial dispute have to be done in writing? I know the PR would have to be, but can the initial "not mine" "I never filed BK 7 in Nowhereville, USA" be an electronic dispute?

it could be...IF you want to do 75% of the work of the CRA for them and if you don't mind a 1 day verification...

 

 

I get that you're saying it should in writing as well, but why would that be me doing 75% of the work for them? I'm assuming you're saying it would be a 1 day verification becaus they are immediately going to say "VERIFIED".

you'd be inputting it into their system for them

 

coding it properly for their electronic "verification" methods

 

transmitting it to the "furnisher" of information

 

all that's left is for their system to fire off an email to you saying it's been verified

 

 

it would be one day because it's ALL electronic...no human intervention at all...

I know this is an old thread, but I am thinking of disputing a tax lien being reported. TBH I have no idea what it is about, or why it is being reported. So, from what I have gotted out of reading this thread, would my best course of action be to:

 

1) send out a letter disputing the validity of the information being reported regarding the lien.

2) wait until I get the letter from the CRA telling me its valid and to dispute with the data furnisher (i.e. the court) if I have any further inquiries.

3) send a letter to the court explaining that the CRA advised me to contact them in order to dispute the validity of the tax lien in question, and to have them verify the information.

4) get a letter back from the court that tells me they do not furnish data nor do they validate information

5) send a letter to the CRA telling them that they did not carry out the investigation properly, and provide them with the letter from the court, and demand that the tax lien being reported gets deleted since the CRA is in violation of the FCRA.

6) enjoy the increase in my credit scores ;)

 

 

So, just curious if anyone can verify that I am on the right track. From what I read, I think this is how I should go about this.

Yea, there are 2 courts showing up in the Creditor Contacts that are courts.

 

oh and +5 for searching first :aggressive:

 

Hehehe, yea I try and search before I ask... and many times I have found myself reading unrelated posts which peek my interest... but its a great way to get a good background for everything :clapping:.

No, YOUR address associated with the lien. From stories on this board, BY FAR the easiest way to get one removed is to have YOUR address associated with the lien off your reports (if possible).

 

on a side note : seemingly unrelated threads have sometimes produced the best information :lol: so, I try to read them all!

Hmmm, TBH I'm not sure where to look. I am looking on my true credit reports and dont see any addresses for the lien. I feel like such a newbie again, lol. Where do I look?
