I emailed the NCDOI earlier to see if if LVNV was licensed in NC. He said no, so i had him check under resurgent. They were.

 

So i e-mailed him about how they never directly contacted the consumer, (me).

 

Here's the response:

 

If LVNV is not contacting you directly, then they are not acting as a

collection agency.

 

If the entity contacting you does not identify themselves and provide a

permit number, they are not in compliance with statutes.

 

You can file a complaint with us and it will be investigated. A

complaint form and other information is avaiable on our website. Link

below.

 

Remember this applies to NC, but it MAY apply to your state also. If you are fighting these guys, check up on this.

All right here goes...Like some of you I had a Sears CO and resurgent purchased. I dv'd them and no answer (1-2 punch) no luck. Then out of the blue LVNV comes into play. Fired off 1st letter with no response. 2nd letter then sent, then I got the typical we bought your account and this is how much you owe printout. Did I mention I disputed with Pryans favorite way of disputing online(just kidding pryan) with all verified and factoring and the 120 late tanking my scores. Well now I have read why not to dispute online and it makes sense. So I get a letter from Hannah & flowers so I dv'd them no response but I do have a hard inq from them. Just sent a 2nd DV to Hannah and flowers with all supporting paperwork. All CRA's have "consumer disputes account information". Sears is not reporting on any of the CRA's.

 

I know I am missing something.

 

 

Jack1212 and KCCutie I need help or anyone else. They have all the violations that you had.

Ok .. I've been in kind of a waiting game with LVNV.

 

It all started last year with a letter from Leading Edge for Resurgent. I DV'd Leading Edge CMRR and heard nothing. Earlier this year I received a letter from WW&R for LVNV. I DV'd and heard nothing from them until today. I received a second Dunning from WW&R for same account but different amount wanting a settlement.

 

I have my paper trail and this is an obvious violation. The letter I received today is not on WW&R letterhead like the first one. But has the address which is the same as the first letter.

 

I'm going to DV them again. Should I include in this DV that I have sent a validation request on this account earlier this year and include a copy of the return receipt, and DV letter?

Typical. When they have nothing, they offer a settlement. You dont need to send WWR a copy of anything. Tell them to try harder at DV.

Jack1212, so LVNV does not have a license in NC, did not contact you directly, so they are not acting as a collection agency. But what if they are listed on your credit reports? I thought that credit reporting was a form of collection, so they are acting as a collection agency in that sense. what do you think?

 

OT: I emailed the DOI, but I haven't gotten an answer. How long did it take them to respond to you?

You have to download and fill out the complaint form on their site.

 

I simply put "see attached" under the details and sent them like 3 -4 pages.

 

I sent it by Fax also. Make a cover sheet. Mine went to the wrong department and wasnt even found for 2-3 weeks.

 

LVNV is no doubt, NOT licensed, resurgent however, is. This is a gray area. cant wait to see how it turns out.

i will. You'll get a letter in the mail stating that they are investigating, blah, blah, blah.

 

That was 3 weeks ago. it takes a while.

 

After you send it, make sure you e-mail them to ensure they received it. (if you sent it by fax).

 

I dont want yours to lay around for 2-3 weeks like mine in the wrong department.

Thanks Jack! I will DV them reminding that I am still awaiting the first DV. LVNV is reporting to CRA's on this also. I did do an online dispute but it came back as verified. So I got the typical treatment as far as the 3 min rule with disputes.

thanks Pryan67. I see exactly why you advise to DV them both (owner CA and dunning CA), so they can't pull this crap! :rofl: That is something that I will NEVER forget to do.

it's getting that time of year. If you send a DV out, you'll get a response around february. This will offer a settlement and take advantage of the Tax season.

 

Very common.

Heck no. The BBB, AG, and DOI are at a standstill. Nothing from anyone. It's been months.

 

I even contacted them for updates. I only got the general "you will hear from us when they respond or the investigation is complete" blah, blah, blah.

 

Another thing i did is this, and it may be working.

 

When filing complaints, throw in a FEW questions from the discovery drafts.

 

That way they see that they will have a hell of a fight on their hands if they go to court.

 

I told them to answer these questions through the BBB, AG, etc.....Or tell it to the judge. It's your decision.

 

I also told them to not even THINK about hiding behind a law firm. LVNV WILL be there. I'm grabbing these SOB's by the neckcollar and dragging them into court after they dismissed my case. Now, it's my turn.

 

HA. Maybe thats why i havent heard from them.
