  1. If I were buying a new bmw, I would opt for the European Delivery option (http://www.edmunds.com/insideline/do/Features/articleId=115580) . I did this when I got my 740iL and it was THE best vacation I have taken. I got to drive MY car on the autobahn and saved money on the duties of a used car versus a new car. Might wanna check it out. BMW picked up the vacation for me (well, most of it).
  2. So, I am returning the vehicle saturday, getting the deal unwound and getting my deposit refunded same day. I dont have to deal with the weasel as I am going directly to the gen manager to get this done. In a way, I kinda want to be vengeful and flip the bird to the weasel when i show up, but I know that solves nothing nor helps anything (other than makes me feel better). I did download a delaership complaint form from the CA DMV and filled it out just in case. Since they are making the situation right, I wont be using it. Thanks everyone for the input.
  3. I tried to return it without success as the weasel wouldnt unwind it. Today, I called the dealership and spoke with the general manager and explained to him the situation. He said he would look into it tomorrow morning because that is not the way they do business there. I told him about my conversation with the weasel and how he made me feel like a scumbag for trying to return the vehicle. I also told the gen mgr that I had contacted the consumer affairs department today and asked for clarification of the rescission letter. What the consumer affairs rep said was that if I received a rescission letter in the mail, the dealership was obligated to comply with it. They asked if I wanted to file a complaint and I told them no, that I would call back tomorrow. I told the gen mgr that I wanted to give them a chance to make things right before I proceeded with legal remedies. I told the gen mgr that I wanted my deposit check the day I returned the vehicle. He said he didnt think that was a problem but would call me tomorrow. I will let you know what they say tomorrow.

  5. Sorry to sound so dense here.....the original contract for the 04 was rescinded and a new contract was signed for the 02, without being forced into it. I got a rescission letter for the 02 and when I tried to return it, the finance guy wouldnt unwind the deal because he said he had financing for me. He didnt ask me to sign a third contract nor has he contacted me to change the original contract for the 02. On the same thread, I havent been contacted by any finance company for the 02. Where I am confused is that you both said the contract was unwound....yes, the first contract for the 04 was unwound, but the new contract on the 02 has not been unwound yet. The finance guy wouldnt unwind it but I do have a rescission letter for the 02 that they sent. This letter says bring the car back, which I tried to do without success. Now, if by having this recission letter in my possession, the dealer has to take the 2nd car back and give me back my deposit then my question is answered. If this letter really doesnt mean anything as the dealer claims because the state forces them to send it, then what are my recourses here? Sorry...I am definitely not car-finance-smart. I am computer smart
  6. I returned the original car, and they unwound the original contract. I signed a second contract, for a different second car. This second car also generated a rescission letter. This second car is the one I have that has not had financing assigned to it yet, as far as I know. This second car is the one that I wanted them to take back since they sent me a rescission letter and this is the car the finance guy said he was not prepared to unwind, although the letter they sent said bring the car back. Do they have to take this car back since they cant seem to get me financed and they sent me a rescission letter?

  8. Here's a question for the pros. I am in California. In the end of November, I started car shopping. I found an 04 Explorer at a local dealership. Went ahead and filled out the apps, put money down and drove away. 2 weeks later, I get a recission letter from the dealer informing me to return the car. I drive back to the dealer and the salesguy says that they want to put me into a cheaper car to make the payments I wanted. I agree on an 02 Explorer with payments less than I was going to pay. 1 week later, I get another rescission letter from the same dealer on the new car (both letterws were certified). I go to another dealership in the meantime and get approved for an 02 Durango. I spoke with the finance company within 3 days and was sure I got the deal done. I drive my Explorer back to the dealer that sent me the rescission letter. I go see the finance manager and he tells me that he is not prepared to unwind the loan because he claims he has 2 finance companies that will buy my loan. I explain to him that because of the letter they sent, they have to take it back and that I already had another loan. The finance guy tells me that is not his problem that I went and got another loan since he claims the state of california forces him to send the letter out if he cant place financing within a week. Here we are in January. Still have not had any contact with any finance company for the explorer and no contact with the dealer since I went in to return the second car. I continue to see denial letters coming in from all kinds of companies both in the original dealer's name and in their sister dealership name. Is the dealer obligated to take the car back since they sent a rescission letter or was the dealer right in telling me that the letter basically means nothing? In the meantime, I have not made any payments on the car (I dont know who to pay to) and the one msg I left for the sales guy has not been returned. Now, I dont mind driving a car for free but it just doesnt feel right to me. Any advise anyone can offer me? Can I force the dealer to come get the car and give me my deposit back? Thanks.
  9. I am in the SD area too...my area houses start at 1 mil. That's why you wont catch me living in Rancho Santa Fe....just kidding....most everywhere are around the mil...my next door neighbor just sold his house for 940K. It is only 700sq larger than mine but he has a fully landscaped yard. I bought mine with dirt backyard and as a bank repo so I got lucky. I live in the PQ (rancho penasquitos) and all the houses in my neighborhood are probably close to if not over a mil... If someone had told me that one day i would be living in a house that was 3 quarters of a million dollars, i would have told them to stop smoking crack...now....hell....maybe we are ALL smoking crack for paying what we pay for houses (nah....sunshine tax....I can dig it)!
  10. I make over 150K a year working IT, non-govt sector. I live in San Diego so most of that salary goes to house payments LOL! The house I moved into was selling for right around 350K 4 years ago before I moved back east. Now that i am back, I am going to be paying 775K for the same house. Salaries have gone up around here but not as drastically as the housing costs. I think we need to start kicking out some of the east coasters that came here to escape the snows! (just kidding). Having traveled the world the last 4 years, I would not live anywhere else BUT San Diego. I may be biased, but I like my 2 seasons...summer and not summer.

  13. From the male point of view, and having been there myself a time or 2, I can tell you that it sucks. The best thing you can do is allow yourself to heal. If that means crying and cursing and whatever else you need to do to get over it, do it. It takes time and there is no sure fire way to make it faster. You need to handle it your own way. Only you know how to heal yourself and you WILL heal when you're ready. All the ideas that came from this board are very good ones (except for the ice cream one....I think thats a cliche and with haagen dasz, a very expensive one). You do need a support group of sorts and it seems you dont really have one. What part of So Cal you in? By the desert reference I would assume you're either in the antelop valley or down 29 palms way. I am getting ready to go home myself after a 4 yr stint on the East Coast for work. I am heading down to San Diego and I have a lot of friends both single and coupled. If you're near SD, I would be glad to "hook" you up with a surrogate support group
  14. I have a 90 and a 75. I always see something new when I look. I dont know that I have ver seen a ping pong sized addition...but it's no tunheard of to have some coral growing where you didnt notice it and then it move out to the open. My Ricordia do that all the time. I am never sure if it's a new one or the old one that moved.
