Hello,

 

I have 2 charge offs on my Experian credit report.

 

1. Equiant Financial Services -status: Charged off - last reported 6/2008 and account history shows charge off as of June 2008 - there is no ":date of first delinquency" so is this the date I use to determine SOL? This was an installment account - would that be considered a written contract with a SOL of 6 years in WA? If so, this is still within the SOL. Report states that this account is scheduled to continue on record until May 2014. This item was updated from our processing of your dispute in June 2010.

 

I disputed this item again online since it says they have not reported since 2008. It is still pending and has almost been 30 days.

 

2. HSBC Bank - status - closed, written off as of Sept. 2008. This was a credit card account so I believe the SOL in WA is 3 years so this one is past the SOL. I disputed it online but it came back as verified.

 

How should I proceed with these accounts? These are the only negative items on this CR so I would really like to get them off. I have been able to start building some positive TL so removal of these would really clean things up.

Most herd do not recommend disputing with CRA's with certified mail. Those letters are most often routed to their legal department, then handled differently.

 

Many result in fraud alerts across all CR.

 

Send them via US Mail.

Most here most certainly do recommend disputing via certified mail. Paper trail is/can be very important if needed later on. With regular mail you have no proof.

I didn't know Why Chat = most here. I respect Why Chat and all he has done/does to help members here, but that is one area I disagree with him on. He may have reasons for saying that but I disagree with that as well. I'm sure he disagrees with me also on some things.

People follow his advice religiously, refer others to his processes, recommendations, and web site. In fact, he is so often quoted his web link is provided for everyone's convenience on this page itself--top right--as he recommends not sending certified for the reasons mentioned above.

So, you still want to make this personal even after I told you that was not my intent? And I really do NOT appreciate you trying to cause a rift between Why Chat and myself. Won't work. Certified mail when disputing IMO is extremely important for proof of paper trail. If it is needed later to prove you did dispute an item, tell me, how will you prove anything?

 

And leave Why Chat out of it. I want your answer.

There is a big difference in different types of disputes. There is no "one size fits all" method. Most of Why Chat's posts are regarding the HIPAA disputes and judgment disputes. The type of dispute and the method really depends on what is being disputed and why. Please don't play "let's you and him fight" on CB. We don't much like it.

I clicked on this link to follow the conversation about CO's as I have 2 I'd like to deal with. The drama is not needed folks.

 

Can we now continue the conversation about CO's?

 

I sent a dispute into EQ a couple weeks ago for things other than my CO's. For some reason they felt it necessary to dispute the CO which dropped my fico 29 points! I think the account was counting toward my AAOA. Crummy way to lose some points for no fault of my own for a change!

 

I have no idea how to get these dreaded CO's off. I have an HSBC and Credit One. I've GW'd both of them multiple times only to be told there is nothing they can do and they will remain for the duration of their reporting. One is due to come off in less than a year and the other is about 18 months away.

Bump...since this thread turned into a disagreement about certified mail and other stuff....I really would like some advise on handling these charge offs. i am thinking sending a validation letter to each and then dispute with the CRAs. Any other advice?

Equiant and HSBC are the original creditors? From what I've read on here, you can send them dv letter if want, but they are not obligated to respond. You may just have to wait for these to fall off. The one thats due to come off in less than a year try disputing as obsolete in a few months.

HSBC is an OC and it says it was sold to Portfolio Recovery Services, but they are not reporting on any report right now. Equiant is a CA.

Wow you guys are so off topic! Anywho, things change it dosent matter what method you choose to dispute just beaware that you should establish a paper trail for your own protection. IMO online disputing sucks and it is not for me but, it might be right for the next poster so to each his or her own.

 

I have disputed by CMRR, US Postail Standard, and Fax and had no problem. To the original poster of this thread, do whats best for you, mail your disputes how you want just make sure you always keep copies of everything.
