They received it Jun 19 and I haven't received a response. I backdoored my reports and it is not showing as being investigated. Next steps? I don't want to send it again and have the claim frivolous or suspicious.

THey received my June 3rd, and I still haven't got the response. However they have investigated and removed two items. GIve it more time they seem to be slower than the rest.

I hope you opted out BEFORE sending the dispute, and tried to get your addresses deleted if you had moved since the date of service.

 

They have until July 19 to respond if it was a paid report, Aug 3 if it was a free report.

I was under the impression that you can do one or the other? Did that change? It seems like the places are willing to remove things more often than not. With all the legalities, etc. I would give it time. Mke sure you watch everything so that you can move to the next step accordingly.

I am concerned I have backdoored experian and see no pending investigations. I know they received my letter, but I am worried because I also sent a jack attack letter to them which they refused to reinvestigate, and another pre hippa which they sent a suspicious request. I am not worried about this medical collection as I got the ca to remove. I am worried though that they completely overlooked my first pre hippa because I never received a response meanwhile they replied my second pre hippa with suspicious request. Should I restart the process?

It is likely your various disputes became merged in their system. Each dispute added 15 days to the response time.

You will have to wait another 60 days for it to clear out of their computer systems before you send in any dispute.

I talked to a supervisor and they claim that they are not breaking any hippa laws. Maybe you could give me more details on what laws they are breaking so I can have an arguing point?

I am also the responsible party for this account....so it's not really my debt. Please give me some tips on how to get them to process my letter.

I suggest that you have all communication in writing, no telephone, fax or internet communication. You do not need an "arguing point" with anyone as there should be no opportunity for anyone to "argue" with any written communication EXCEPT in writing.If you want to understand the HIPAA letter program, go to this link, ( on the HIPAA letter program page)

You can not "demand" deletion from anyone.

 

If you have sent the initial dispute

Who is "they"?? The medical DV contains an absolute cease and desist, they are precluded from adding it to other reports. If the "they" is Experian, there is no comity between CRAs except for fraud alerts.

They as in Paragon Revenue. If I send them a medical DV can they turn around and report it to TU and EQ if they validate the debt?

Which is it?? How are you responsible if it is not your debt?? How old is it??

 

If it is only on one report, then they would have to violate all the FCRA, FACTA and FDCA statutes to add it to your other reports.

 

As to giving you "tips" on processing the letter-- are you talking about the medical DV?? you send it certified mail only if it is going to a PO box, you send the re-dispute to Ex as soon as you have proof of receipt.

 

If that doesn't work you can always file an FTC complaint against Ex.

I was a signer on a medical bill so I am technically responsible. It is 4 years old. I just wanted to make sure...cause I saw a thread where a person sent a DV to a CA and they verified it then started reporting it to additional bureaus.

If a DV is a "standard" DV that might occur, however the medical DV prohibits this

Please also be advised that this letter is not only a formal dispute, but a request that you cease and desist any and all collection activities, including reporting of; or verifying of this account on my credit reports.

Ok thanks so much for the help. So after I send the Medical DV should I wait for a response? Or immediately send a followup letter to Experian?

You send the re-dispute to the CRA as soon as you have proof of delivery ( print out from PO website or green card)to include a copy of with your re-dispute.
