Can the Collection Agency Sue Husband for My Bill

I am wondering if the guarantor for a medical bill for one of our children can be changed from my name to my husband's name. There was no insurance involved. I am disabled and have no income for them to garnish. He has been sent a letter from the attorney and I've spoken with them and the court case is for mid January.

What do you mean by "guarantor"?? If he signed financial responsibility when the child was admitted, then yes, he can be held liable.

I have a hospital sending me bills for my son and I havent signed anything. Am I still responable for the bill? even though they called me and ask for my permission to treat him ,but my mother signed for it and told them she would pay the bill. Now they are saying they will send it to collections....also they added in bills where other folks had brought him prior to this visit.

I think by guarantor she means is the person that signs for the person to be treated?

You should try for medicade (not Medicare) for your kids. If you apply for it now, they can sometimes go back and pay for the debt. It will also show the judge that you are fixing the problem. If your income is on the boarder. You can fill out a special form not to include your husband incomes. However, that depends on the state. In the mean time, if you have your disability check deposited. Go to your bank and have them note on that account, that your account can not be garnished even with a judicial order because your are disabled. They will need proof that you are disabled. You award letter should suffice. Then switch to using the SS or SSI debit card. If it is a joint account with your husband, Remove him.
