Of course I can't get anyone on the phone because it's Saturday, but I'm so furious it's not even funny. Alright, here's the story.

 

When my DH and I filed our state/federal taxes last year, we did not notice our tax preparer did not complete the tax credit sheet for NC. We read the tax return but didn't notice it. We just noticed we owed $2500. So we mailed the return in, and when we got the notice about making payments, I called the number on the sheet to make payment arrangements. The lady I spoke to on the phone asked me why we didn't fill out a tax credit form. Well, after reviewing the tax credit form online, I noticed we did have several credits we could claim. So, in April I filed an amended return and now NC owes us $3500. Every month since April we have been receiving a bill from NC saying pay up and nothing about our refund they owe us.

 

Well, last Saturday one of the NC income auditors called and asked me to fax her our Federal return and my W2 again so she could "get this all cleared up for us" so we could get our refund and clear up the debt that is not owed.

 

In today's mail I got two letters from NC--one was a bill again, and the other is a notice they have contacted my employer to begin garnishing my paycheck for taxes I "owe" from 2006! There is no information about them owing us $3500 or when to expect the check from them!

 

I'm so ticked off. I can't contact anyone with NC revenue because it's the dang weekend. How can they do this when they owe us money?! Does anyone know how to get this stopped? We don't owe them a dime. How can they do this when they haven't even processed our amended return?!

 

I haven't even told my husband yet. We didn't get a notice about them garnishing his paycheck yet. It doesn't even say how much they plan to take. How do we get the money back they take out? We don't owe anything!

Check if there is a tax payers advocate in your area they might help you clear this up. Google it or look at the IRS website for the info. I had a friend with a similar problem that they helped with.

I have found NC DOR to be real quick at garnishing but also real slow at resolving consumer-favorable issues. If you are a NC resident I would say that you should contact your State Legislative Representatives and ask for their help. The fact that it has been several months since you filed the amendment should work in your favor with them.

 

Another tactic might be to get on the phones and don't give up until you get a satisfactory answer from a supervisor and don't take "no" for an answer. You want to stay in the Collections division since they are the ones with the ability to actually get something done. Be ready to fax a copy of the Amendment to the Collections rep and you can get the Levy released on that basis alone. Everyone has a boss in State Government and if you're not talking with the Governor you haven't yet found someone who does NOT have a boss.

 

This issue isn't a collection issue, it is a Processing issue. I had a case in NC some years ago that took 6 months for an Amendment to get processed. It seems NC hasn't improved any since then.
