Didn't know where else to post this. Not Medical but this is the only collection forum.

 

I have a collection on all 3 reports that I know is legit from a cell phone bill(AT&T) from 2001 I started recieving settlement offers from Cavalry Portfolio Services, LLC (third party) about July of last year. I haven't made any contact with them yet but have tried to dispute it on all 3 CRA's twice but they came back as valid within a week. Out of state CA are exempt from being licenced and bonded in Wastington as in most states now. The original debt is only $188 and I want to pay it but I don't want it to remain on my credit reports after I do. It's the only negative mark I've had in 4 years and don't want it there when I buy a house at the beginning of next year. I was going to pay it last year, then I found this place and read a little about ways to get rid of CA's. Mine is legit and I have no problem paying it but how do I go about paying and getting them to remove it from all 3 CRA's

 

I know this is probably an easy answer for some of the credit masters here but I'm fairly new. Established my credit only 6 years ago. I got payed in cash and I payed only in cash up until I was 26. Then I woke up.

well, you could go for a PFD...

 

have you DV'd the CA? DO you know that they still own the account? If so, how do you know that?

No I haven't Made ANY contact with them but they send me something usually every 2 months. So yes, they still own it. I'm not trying to just weasel it off my report. Just want to know if there is a way to pay it and have it removed from my report instead of showing as "paid collection".

so if I send you a letter saying that you owe ME money, you'll just assume that you do...

ok...since you're bound and determined to pay the people that CLAIM you owe them money (since we know that CAs would NEVER lie or anything of the sort), have you read up on PFDs?

Them sending you something every two months does NOT mean they still own it.

 

Start in the newbies section. Read all about Debt Validation. Make them prove that it is yours, that they have a right to collect, and that the amount is correct.

That is def. the first step. DV them.

You also want to start getting some leverage on them. It makes it easier to DEMAND a PFD.

Have you read about SOL? How old is this debt. When was the DOLA?

My sister and I had a collections from Cavalry for an unpaid AT&T bill also. This is what I did at first, I sent them a DV letter certified mail, and of coarse they didnt respond. Next I sent a copy of that letter along with my green card to EX asking them to delete because Cavalry failed to respond. They deleted within a week.

 

And as for my sister, this was a legit account. I tried something new this time, I recommend you going by the way I did instead of my sister. As for hers, I just disputed with EX saying Cavalry failed to validate, and poof, gone within 4 days. Hasnt been reinserted since, and this was over 6 months ago.

 

Like I said I recommend you DVing them first to keep a paper trail. I really think Cavalry cant really validate on thoes old AT&T bills.

Do as the others said. Always DV first to see if this is truly your debt. Also, I couldn't find them as licensed in WA but you need to send an email to the licensing board to make sure that's the case. They may also operate under another company that is licensed. If they are not able to collect then you should not pay them.

Here's a funny update to my collection. Sent DV letter in Nov and checked all 3 CRA's 2 weeks later and poof! gone no collection on any of em. Cool they let it go I thought. Well here it is exactly 6 months later and I get a letter from Cavalry saying:

 

"In response to your debt verification request (although I stated 3 times in my letter for Validation and not verification), please be advised of nthe following:

Enclosed herewith is the information requested between Tate74 and AT&T.

In light of the foregoing response, Cavalry portfolio services, LLC has now fully complied with 15USC1692g(:wave:.

Please be advised this communication is from a debt collector. This is an attempt to collect a debt and any information obtained will be used for that purpose.

Sincerily BLAH BLAH BLAH

Came with a copy of the original bill too

 

It made me laugh when I got it, haven't checked My reports yet but I think it might be back on there. Just sucks right now because I'm planning on buying a house within a month. oh well

Were they gone because you disputed or because you sent a D/V and that was it? this account is way past the SOL if it is back on you have 3 options.

 

 

1 If it was dispute to the CRA and it was gone and then came back and you did not receive a reinsertion letter within 5 days they (CRA) have to remove it.

 

2.If it is on your reports and it is not marked in dispute you can file a small claims on FDCPA violation and since it is past SOL they will fold.Happened to me that way with them.

 

3. If you want send a PFD again since it SOL that is the only way they can legally get their money from you I say their money loosely as they probably paid $10 for that bill to collect.

They were gone after I sent DV letter.

 

I probably should of sent copies of everything to all 3 CRA's after they didn't respond but I figured they just let it go since it was wiped off my reports.

 

Alright, I just went and got all 3 reports (while writing this) and it's not on any of em. The letter I got is dated April 24th so F em

I would still fire off a second DV, telling them that what the sent is NOT validation by any stretch of the imagination
