Any suggestions on the best way to get CBCS to stop reporting every month on a dental debt that is past sol? DOLA is 12/99 and they just started reporting a few months ago.

I had cbcs on my reports for an old comcast debt- i tried everything- i went to the cb's, i sent letters-dv, its, etc etc, i went to the bbb and the ag for my state and theirs- ohio.

 

 

finally i went to the oc-comcast and told them about the not answering the bbb, ag, and other inaccuracies and they ordered it back and had it deleted immediately.

 

there are afew things you can try- i was turned down for pfd but they were recently in trouble with the ftc and from what happened to my hubby i think they are looking for some outs with out loosing money- try a pfd letter but first if you haven't already dv them see what they do- (ignored me but i know they have answered others)

 

pfb the original creditor- cbcs does a lot of work for oc's without actually purchasing the debt therefore they can sometimes help-

 

lastly- read the newbie section 3-4 times- i read it 9-10s when i started and still didn't get it all. it seems tedious but it does help....

Of course I'll follow up w/ CMRRR hard copy. I just feel like bugging them today by faxing copies of all my complaints (FTC, BBB, AG, whatever else I can think of. Also cc ing the OC, BellSouth, b/c Bellsouth supposedly "prides itself on its customer service," yet they sent a non-existent account to CBCS!)

I believe that CBCS is committing fraud by making false and defamatory entries on consumers’ credit reports in an attempt to extort payment for debts not owed.

 

I am aware of many cases in which imaginary delinquent accounts are “sold†to CBCS, who then attempts to collect on these imaginary debts. But, when a consumer- who has often never had an account with the alleged original creditor- contacts the original creditor for information, the creditor agrees that there is no record of any such account ever existing.

 

If CBCS is not creating false accounts, at the very least CBCS is making entries on credit reports without a shred of documentation to substantiate the existence of the accounts. This is of course a violation of the Fair Debt Collection Practices Act.

 

Also, CBCS refuses to respond to consumers’ requests for information, as required under the FDCPA. I have enclosed copies of my letters to CBCS to document this ongoing problem.

 

I am concerned not only with my individual case, but with the very alarming fraudulent practice of creating fake accounts in an effort to collect small amounts from consumers. It is very telling that these fake balances tend to be small. I have no doubt that CBCS thinks that people will pay these small, un-owed balances just to be rid of the problem.

 

Please look into this very disturbing practice as soon as possible.

CBCS was on DH's report for an old phone bill that DH knew NOTHING about. I tried DVing and disputing and they wouldn't delete or even respond. It wasn't until I emailed both the OH BBB and AG that I finally got it deleted.

I reported them to the MI AG OH AG FTC and the OH BBB....I got a response back from the OH AG that there is nothing they can do for my complaint and are sending it to the FTC :dntknw:

Linx04, did you allege that CBCS could be committing fraud? If so, then the OH AG should certainly be concerned and willing to investigate.

I received a response to my BBB complaint today. I've pasted it below:

 

>>>>>This account has been updated as "in dispute" on the credit report, as of 12/5/05, when we received the first letter of dispute. Please note that this first letter of dispute was received TWO YEARS after CBCS had already been collecting on the account. A copy of the final bill was mailed out on 1/18/06 as proof of the debt. If (consumer) has proof that this account has been paid in full, we will need to see proof in order for our client to investigate. BellSouth has not confirmed that this account was paid in full and alleges that this balance is still past due.<<<<<<

 

 

Truly unbelieveable! I'm sure we can all spot the problems with this response, but just in case anyone needs a form letter, I've pasted my response below: (it was an email response form, so I don't have the normal name / address info of the BBB as a header to the letter. )

 

 

CBCS's response to my Better Business Bureau complaint is alarming in its false statements and its deliberate attempts to misstate consumer rights.

 

As I am sure CBCS is aware, it is irrelevant that I contacted CBCS two years after it claims it began collection activity. (More on the falsity of CBCS's claim below.) Under the Fair Debt Collection Practices Act (FDCPA), a consumer is at any time during the collection process entitled to an itemized, authentic accounting of the amount CBCS claims is owed. It is quite shocking to me that, rather than just providing documents when a consumer requests them, CBCS instead responds with vague and misleading statements in hopes the consumer will waive his or her rights. This speaks volumes about the quality of CBCS’s documentation practices and the authenticity of the “debts†it claims to be collecting.

 

[Of course it may be that CBCS simply does not understand the law in this area. In that case, it has no business being in the debt collection business and should have its license revoked. I am forwarding this matter also to the relevant authorities.]

 

Next, CBCS fails to mention that I contacted it as soon as it listed the item on my credit report, and that CBCS made no attempt to notify me of this account prior to its listing the account on my credit report in late 2005. I find particularly shocking CBCS’s attempt to imply that I waived my rights to validation because I did not contact it during the first thirty days it “attempted to collect this debt.â€

 

As I noted above, CBCS did nothing to contact me during the two years it claims it has been “collecting†on this account. In fact, CBCS appears to deliberately "sit on" accounts until it can convince a consumer that he or she is "too late" to request debt validation. Then, CBCS throws the old item onto a consumer’s credit report, and tries to imply that the consumer has waived his or her right to validation. This is both an illegal business practice and possible fraud, as CBCS is required under consumer law to disclose that consumers have certain rights.

 

Because CBCS has chosen to lie in its response to my complaint, I must ask CBCS to specify what attempts it made to notify me of this account during the "two years" it claims to have attempted collection. Please ask CBCS to provide copies of any documents it used in an attempt to contact me during this two-year period.

 

Next, CBCS still has not provided me an itemized, authentic Bellsouth bill documenting the amounts it claims are owed. I have requested this documentation multiple times since December 5, 2005.

 

The only thing CBCS has provided is its own internal word processing document reading, "amount past due $165.02." None of these charges have been itemized or explained, and CBCS has not provided a complete accounting of my Bellsouth account, which would be necessary to determine whether or not these charges are owed.

 

Again, I have requested this for over two months. CBCS has repeatedly violated the deadlines and requirements set forth by the FDCPA.

 

CBCS further misstates consumer law by claiming that I need to prove I do not owe this debt. CBCS is well aware that the burden of proof lies with CBCS to prove that I do owe such a debt, and it has not provided even a bare minimum of documentation as required under the law. Again, CBCS is deliberately trying to misstate and mislead a consumer. And, apparently, CBCS has great contempt for the BBB to include such outrageously false and misleading comments in its BBB response.

 

I have asked CBCS to have Bellsouth authenticate CBCS's word processing document. Bellsouth has not done so. Why doesn't CBCS mention this in its response? Please ask CBCS to specify the date it spoke to Bellsouth about this account, and the name and contact information of the person with whom CBCS spoke.

 

Next, CBCS never listed this account as "in dispute" with the credit bureaus, and still has not done so. Please ask CBCS to provide proof that it has made this notation on my credit report.

 

I have repeatedly offered to pay any amounts I owe. Unfortunately, CBCS has not cooperated in the least. It has brazenly and repeatedly violated the FDCPA, and is even so bold as to lie in its response to a BBB complaint. And, just in case its lies don't work, CBCS falls back on making misleading statements designed to misstate consumers' rights.

 

The BBB should be very alarmed by CBCS's business practices. If you need additional information documenting each of the violations outlined above, please do not hesitate to ask.

 

Please also inform CBCS that I am forwarding its egregious BBB response to the Attorneys General of Ohio and the District of Columbia (where I reside) as part of my ongoing complaints with their offices regarding CBCS's dubious business practices.

 

Perhaps of most concern to me is the following. Please ask CBCS to describe in detail why it repeatedly (four times) verified this item to the credit bureaus during the period from December 5, 2005 to January 18, 2006, in violation of the FDCPA.

 

I requested validation of this debt in a letter which CBCS received on December 5, 2005. CBCS did not provide any response until January 18, 2006, when it sent me an internal word processing document (which, incidentally, was not remotely sufficient for proper validation.) Yet, CBCS verified this item to the credit bureaus four times (at each bureau, for a total of eight violations of the FDCPA) during this time period.

 

Finally, please also ask CBCS to respond to each item I requested above. If it cannot or will not do so, it must delete its listing on my credit report with all three bureaus and send me a letter documenting that it will cease collection activity and refrain from any attempts to re-sell or transfer this alleged, undocumented, and nonexistent debt.

Yesterday, however, I got a letter from the OH Atty Gen office. It included a copy of CBCS's response to my complaint.

 

CBCS did not respond to ANY of the issues in my complaint. They also lied about trying to collect on the "debt" since 2003. Finally, they mentioned, "we will ask (consumer) to complete an identity theft packet so we can investigate further."

 

ID theft has NEVER been an issue in my disupute. CBCS is insisting that consumers must prove we DON'T owe the debt instead of CBCS needing to prove that we DO!
