had several favorite placed on my old computer before it crashed, and I'm having a difficult time finding them with the new forum layout.

 

i'm searching DV letters, nothing. also looking for HIPPA sample letters, not getting hits on that either. am i doing something wrong?

Please allow this correspondence to serve as my formal notice of dispute. Please send me any and all information you have regarding this disputed account to the address above so I may take the necessary action to complete the dispute resolution process.

 

Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15USC1692g(B) that your claim is disputed and validation is requested.

 

In accordance with the above statute(s), I am asking that you prove that you have the correct debtor, the correct balance and that you are legally authorized to collect this debt, by providing documentation establishing the following:

 

• Name and address of Original Creditor

• Name, address and account number on file for alleged debtor

• Amount of alleged debt

• Date that this alleged debt became payable

• Date that the account originally became delinquent

• Verifiable proof that I have a contractual obligation to pay your firm.

• Any agreement that bears my signature, wherein I agreed to pay the creditor.

• A copy of all statements while this account was open.

• Any documents that grant your organization the authority to collect this alleged debt.

the search function blows on the new board layout. Everytime I search for this thread, it does not come up. I try searching for myself (the author) and it doesn't work either. In any case, I'll be sending out DVs Monday. Pretty excited

When I sent out my first DV I used one of the ones I found on the internet that asked for everything including the kitchen sink. I've setlled on the simpler the better.

 

I really believe that when you ask for things that they don;t have to give you they are of the belief that you don't know what you are doing, if that is the image you want to portray thats okay

 

but we all knoiw collectors tend to screw up regardless of which way you go.

 

I usually send one that reads like this

 

Dear Scum of the earth

 

This is not a refusal to pay. I have received your letter dated 10-1-11 postmarked 10-8-11 on 10-13-11 regarding an alleged debt with Bankster One.

 

I dispute the debt in its entirety and request validation pursuant to the FDCPA

I don't feel that I have to have a conversaqtion with them or use a lot of legal mumbo jumbo or even remind them what a violation is or the penalty for violating, They know the law, they know when they are violating,

 

My way of telling them they are violating is by sending a summons.

 

I believe that you need to be careful when sending a DV or jump the gun and send one before you get their dunning letter. a lot of folks look them up after getting a phone call and send out a DV right away. Why would you want to do that? They have 5 days after the call to send the letter,

 

let them send it, the dunning letter may have that violation you need for a counter claim or be a valid FDCPA claim. I don't think its wise to do a Cease and Desist or a refuse to pay to early either UNLESS they are out of SOL and you just want them to go away and leave you alone.

There should be 2 search boxes on your screen - one of them is google site search, which works very well on CB. The other one - well, we don't like it either. :D

.I'll type out the letter I plan to use. And again, the question is whether or not I can include all three charge offs in one letter simply by including all three account #'s. Also any critique on the letter is welcome

Send the following DV letter to the CA for non medical accounts. For medical acct's use the Whychat method.

Dear CA,

 

I am requesting validation of the alleged debt listed below pursuant to the FDCPA.

Please also cease all communications with me by phone. All future communications with me must be done in writing at the address listed below.

Do NOT include your ss# or dob and do NOT sign the letter!

I'm a little confused now after reading through PsychDocs document to refresh my brain... I knew I shouldn't spent time away from this damn board.

 

I send the DV letter out to CRAs right? ie TU, Equifax, Experian...right?

 

I have three charge offs, so I write the DV letters to all three CRAs, and list all account number charge offs that appear on my credit report... and for my third charge off (medical) I do why chat's method.

DV letters are only sent to the CA. Never send a DV letter to a original creditor or CRA.

DV letters are only sent to the CA. Never send a DV letter to a original creditor or CRA.

 

CA = collection agency (as shown on credit report)

 

CRA = credit reporting agency (ie TU, Equifax, Experian)

 

right?

 

I used to have a sheet favorite placed that clarified all these abbreviations and I got a new computer. Does anyone have a link?

 

So my DV letters are going to the collections agencies, not TU etc. Thank you for clarifying.
