To Whom It May Concern:

 

I have received your letter requesting more information in regards to above mentioned account. I have included a copy of your letter in this mailing. There must be some confusion as the reason I sent you my validation letter was because I have no knowledge of this account.

 

Since its apparent you don’t have this information I should also bring to your attention that this Debt is listed as “Verizon Wireless†and according “47 USC Sec. 415†this debt’s SOL has expired.

As such I demand that you remove this tradeline from all three credit reporting agencies before I’m required to pursue further legal action for the reporting of Inaccurate information.

 

 

 

 

This letter is going to Midland credit as they sent me a please send us documentation support your dispute letter. Its for an old verizon account with the first deliquency listed as 01/2005.

I would not use initials in a letter. I don't mean in quoting federal law, write out statute or limitations. Rather then I demand, I would say "The law requires..."

 

 

I would also be clear that there are two reason's to delete the tradeline. 1. can't validate 2. SOL

If you have no knowledge of the account, how can you say the debt is SOL?

I'm just basing the SOL on what they say the accounts first deliquency is. I figure saying I dont know anything about this account wont get it removed, but pushing the other matters will.

Then I would say that, "Based upon your own statements (or reporting) this alleged debt is uncollectible (or unreportable)." Is it beyond SOL for collecting or for reporting? If it can be verified, then it can be reported for the duration of the reporting period even if the SOL for collection has expired. If it is still within the SOL for reporting, but not verifiable, then you may want to base your demand upon lack of validation, not SOL.

Ok I updated the letter. How about this better?

Based upon your own reporting and statements this alleged debt is uncollectable as it violates federal law 47 USC Sec. 415.

Due to your inability to Validate this debt and your attempts to collect upon a debt that’s statute of limitation has expired the law requires you to remove this from all three major credit reporting agencies.

Failure to comply with these federal and state laws will force me to pursue further legal action.

Just because it's out of sol for collecting,doesn't mean they cant report.

 

If the dofd was 2005 wouldn't they be able to report till 2012 ?

 

And don't forget they're 4 cra's, they may be reporting to Innovis as well.

Hmm, does it sound like my letter is coming from the wrong angle then.......More like I am saying since its SOL you have to delete.

I moreso want it to be...

You cant validate, and on top of that its out of SOL...so just delete..before I need to do something.

There must be some confusion in your camp. It's your job to validate. Not mine. If I knew anything about this account, I wouldn't have needed you to validate it; now would I? 

There is one piece of information about the account that I will gladly share. Per your own reporting, this alleged debt is uncollectible as the statute of limitations has expired. Your efforts to collect from anyone are probably in vain. I think you are just spinning your wheels.

Since it's obvious that you lack information about this account and cannot validate per state and federal law, the law requires that you delete it from my credit file. 

Send confirmation that you have deleted from all credit agencies to whom you are reporting by xx/xx/xx or I will be forced to pursue further action.  I will not shirk from holding you responsible from all harm.

Do not call me or anyone else about this uncollectible, alleged debt as it is inconvenient to receive calls from you at any time or any place.

Would you actually send this saying Dear salamanders? Wasnt sure if that was just for illustration or what you really do.

 

If you are sending a letter, it should be professional. Never put anything in writing you wouldn't want your mother, your priest or a judge to read. Empasis on a judge to read.

Nah, I would leave out the salamander salutation, but I would be thinking it. :P

 

Otherwise, I am all for plain English. They aren't rocket scientists over there so just say what you want to say so there is no confusion about what you are trying to communicate.
