i sent a pretty nasty letter to Midland telling them that I have sent them many letters within the last 8 months, notifying them that they were reporting wrong and that they had many chances to correct or delete the information on my CR. i told them that I will be forced to retain counsel and sue for damages. Today, I got 2 letters in the mail saying:

We have opened an investigation concerning your recent request and have requested the appropriate documents.

A consumer representative will provide a response to your request...... but I have never in any letter I sent asked them to investigate the 2 accounts ( 1 on each letter ).

Now that I have these letters which show creditor and current balance, what should I do? Thanks in advance !

Hi, It looks like you started a firestorm with Midland. Are these accounts past the state SOL? If not you have put yourself in a position to be sued unless there are violations on Midlands part. Do not give Midland any information they should already have in their files. Are either old medical debts?

Sandscrit...yes...I did start a firestorm because I got 2 of the Midlands originally on my reports off of all 3 CR's. 2 remain that show paid in full but on EX for one of them the account is showing open and not closed. I sent a letter to Midland telling them to correct or delete, and they have not done either. Its been over 60 days since I sent that letter. I recently sent them another letter telling them about me retaining an attorney attorney, and I get the 2 new letters for 2 more accounts. I know one is SOL but the other is still in play. I do not worry about them suing me as I do have the money to pay. What should I do with the NEW letters I got saying they are investigating? DV them?

The 2 new accounts Midland is "investigating" is for GERB Care Credit. Does that count as medical as it was for a dental bill. The other is the SOL one for a loan with Citi but I know what to do with that...FOAD letter.

under the FCRA if your file a dispute , they are supposed to " rei-nvestigate"

 

Under the FDCPA if you dispute a debt, they are supposed to verify the amounts with the OC, and supply documentation of the amount owed by the OC.

 

You really expected them not to do this ?

 

You didn't think they wouldn't send validation after you send a intent to sue letter?

 

What was your game plan on the outset?

 

are these debts within your States SOL for lawsuits?

ICANHASMUNY....lemme try to reclarify what I wrote. ( My mistake on my original post) I was on the boards all day and my mind was a little fried. To make a long story short, I sent an ITS letter to Midland for 2 accounts that they are continuously reporting wrong on my CR. I listed the Midland account numbers which were for both of those accounts telling them that they had ample time to correct or delete, but have done nothing till this date. It's been over 60 days, and I have not heard anything from them in regards to those accounts that I wrote them about. Last week I received 2 letters from Midland saying,

 

"We have opened an investigation concerning your recent request and have requested the appropriate documents.

A consumer representative will provide a response to your request."

 

These letters I received from them, have two account numbers with creditors and amount owed, but the two accounts and creditors are NOT the ones listed on my CR that I originally wrote them about.

 

Whats your take on this?

are these new account that they refer to valid accounts that you recognize? Had they fallen off and now they are back on? is all of your correspondence CMRRR? I think that they are trying to intimidate you but I think that you need to see where your slip is showing and make sure that they don't have stuff on you that you had not realized...ITS letters before CFPB may incite them. Especially if you are not really going to sue them...

Are those your accounts too?

 

if they are not, they have yo mxied up with someone else. which is probably a good thing.

I am intending to get a lawyer. I have CMRRR many times ( over 5 times) and they either have been ignored, 2 TL's deleted, and the 2 on my CR still reporting wrong. Sick and tired of Midland....

Send a letter back to Midland stating that the reply is confusing, since these are not any accounts you've been notified of before,

 

 

Dear Midland

 

On many letters sent to your firm since xx-xx-xxx ( copy attached ) I disputed accounts # ______________ & _________________.

 

Your response was to send letters on account # ____________ & ___________________, of which I've never received any notification from your firm before, and these letters on the new accounts are lacking in the required FDCPA validation notice.

 

This is very confusing, for the past 8 months I've disputed the accounts listed, and your firm never replied, but continued collection activities and reporting without validation.

 

And when you do reply, it's with letters on 2 accounts i know nothing of, and of which I've never been contacted on by your firm or agents.

 

either you cease reporting and delete the accounts disputed, or i will turn this over to an attorney for review and legal action and file complaints with the CFPB for FDCPA and FCRA violations.

Thanks ICANHASMUNY......I was kinda suprised when I got the 2 letters in the mail and they were not even on the two accounts I wrote them about. I appreciate you stepping in and helping me out. I appreciate everyone else too.
