Dear WhyChat,

 

 

 

I have read around the forum and you seem to know exactly what to do so perhaps you can point me in the right direction.

 

 

 

So far i have sen letters to dispute this one medical collection on my CR. Transunion removed it and Experian & Equifax verified it via e-Oscar.

 

I have been reading around and many people say that if i send a DV letter to the CA then it may be removed.

 

 

 

Then i came across your HIPPA Process and i am not sure if i can use this still.

One other thing it says that i must have the CMRR# where can i get that? SHould i call the original creditor to obtain that information?

 

Also on one of the letters it says do not send it RR. What does RR stand for?

Make sure you HAND ADDRESS the envelope, use personalized stationery and purple or teal font, ( preferably italic this is helps prevent the automated scanning/reading/response computer programs from "reading" your letter as they can not read handwriting or distinguish font in the same color family as a background pattern).

DO NOT send it RR -WAIT FOR THE FULL RESPONSE FROM THE CRA BEFORE CONTINUING WITH THE HIPAA LETTER PROCESS

Should i send the CA registered mail with a reciept? I think the answer is yes but want to make sure. READ THE INSTRUCTIONS! .IF YOU HAVE ONLY A PO BOX ADDRESS, DO NOT USE THE RETURN RECEIPT, SEND IT CERTIFIED ONLY AND PRINT OUT THE ON LINE PROOF OF DELIVERY FOR THE FOLLOW UP LETTER Do a separate letter for EACH CRA that the CA is reporting to, make sure the account #'s match the report. You can MAIL them all to each CA in ONE envelope with one CMRR

Because one of the letters has CMRR# in it.

When you get the certified mail form, it has the tracking #. When you fill out a RETURN RECEIPT you detach one of the tracking # labels FROM the certified mail form and affix it to the return receipt.

 

In other words, it is the CERTIFIED MAIL form that has the tracking #

 

You do NOT want to send anything that requires a signature to a PO Box, so you would put the SAME certified mail tracking # in your letters ( pick up a few of the forms at the PO before you start disputing so that you can incorporate the # into your letters).

Whychat,

 

I have a quick question for you.

 

I have written my letters (On blue/cloud staionary in purple font with a Confidential watermark in teal diagonally across the paper) and picked up some Certified Mail slips at the post office.

 

I am all ready to send them out to the 2 remaing CRA that still have this collection on them but i have one dilema.

 

I recently disputed with the CRA with a "Not Mine" request and Equifax came back saying it was verified. ( I left this one alone because of the situation below did not pan out)

 

Experian came back saying verified so i called them up to argue it saying i spoke to the original creditor and they said they had no paperwork on this. I submitted the OC information over the phone and requested an investigation be done. They said they would contact the CA i said no i want you to contact the OC they said they cant. Then I got another letter saying it was verified.

 

Can i still submitt this Pre-Hippa letter or will they say it is frivoulous?

 

Also should i include a copy of my drivers license? What about a copy of my CR?

When you "checked" the box for e-mail notification it defaulted ALL your disputes to e-mail notification, it also likely opted you back in.

Go on line and opt out again

 

If you have the dispute # you can check THAT dispute on line.

I don't know how you can "unring the bell" for getting your disputes answered on line.

When i sent the 2 letters to the CRA's i forgot to put it on custom stationary so it was just on white paper but the font was purple and i had a teal watermark across the page saying "CONFIDENTIAL".

 

WIll this hurt my chances of a computer picking it up instead of a person?

 

 

 

I also forgot to send it CMRR and only sent it CM because both CRA's addresses were PO Box's.

 

Was this the right thing to do?

Only the INITIAL dispute letter to the CRAs needs to be "unscannable" all other correspondence should be properly typed and "Courtroom ready".

I got a letter today from the CA saying the following:

Dear XXXX,

 

Our office is in receipt of your letter of dispute and request for cerification pursuant to 15 U.S.C. 1692g(1) (4) of the Fair Debt Collection Practice Act. Please be advised we have reviewed your dispute and concluded your account is paid in full. Therefore, we have ceased collection of this account.

 

Should you have any questions regarding this matter, please feel free to contact us at the number below.

 

Very truly Yours,

 

xxxxxxx

Under that they have their name and address as well as the hospital name and address the medical collection originated from.

 

As well as my name the account number the date of service and the current balance.

 

 

 

The CA didnt say they stopped reporting the debt to the CRA's

 

My CM letters didnt make it to the CRA's yet and show they will arrive tomorrow.

 

Should i do anything regarding this letter or wait for a response from the CRA's?
