No lates on other accounts Why not call AMEX and see if you can upgrade to PRG? I think it's a soft pull? Or are you wanting to apply for the PRG for their $25K membership rewards bonus? -

30 days rule only applies to the State of Texas as far as I know. There is no time limit in which a CA "must" validate. However, if they receive a dispute/ DV, the CA must cease collection efforts. In your case, Midland has IMO validated your debt by sending you copies of the original statements (furnished by the OC). They're under no obligation to show you the chain of assignment. Unless they took you to court, that's a different story. Per FDCPA, they have properly responded to your DV.

Is this by any chance in regards to a Time Warner or Comcast bill/ receiver? If so, you should be able to go directly to the OC and pay them directly so you can get the tradeline removed from your reports.

By any chance did this call come form a call center in India? When you said payday loans, this is the 1st thing the came to my mind. A CA based of the USA, calling at 1AM, is truly an salamander. -
From what Manny says, it means that "if" you were to PIF/ SIF, and THEN dispute the account with the CRA's, the tradeline might get deleted because the CA might not respond to the dispute.

If you're severely past due on your 2nd mortgage, you might be able to settle with whoever owns/ services the loan. I've heard banks/ servicers settle anywhere from 15-30% of the balance.

I agree with consulting an attorney. The only problem I see with it is that if she's telling the truth about her finances, she couldn't afford one. Do any attorneys offer that kind of consultation for free? I know a lot of attorneys that will give free consultations. And if OP were to retain one, a lot of them do offer flexible payment plans. Just be sure to consult with more than 1 attorney to see what they have to say. OP, the fact that you're coming out and seeking guidance is great. At this point, seek legal advice and weigh out all of your options!

With attorney-client privilege, it couldn't hurt for the OP to seek advice from an attorney, yes? IMO, I think a duck and hide on a "credit card abuse/ fraud" case is a bit dicey. Lets say the OC places the account to a CA, and then the CA runs a typical skip-trace (as they all do). Then, they get a "hit" that the borrower is deceased. At that point, the account is sent back to the OC for further review. From there, the OC's receivables management analyst realizes that payments were made while date of death does match up. Would you really want to play with fire? I don't think it would hurt to consult an attorney and see what other options exist.

thanks well I wonder if it is worth it. Anytime I travel for client related services, I am required to use my corp Diners club when it comes to airfare, hotel, car rental, food, and related business expenses. IMO, Diners can not stack up to AMEX. Our club rewards points program have diluted since the Citi acquisition. For an example, in 2005, Continental, United, and US airways left the points to miles program.

As of now, yes. I work for one of the big 4 accounting firms, and our corp card is Diners. I wish we used AMEX.
