Hi CB, Here's a quick update! Well Wachovia contacted my friend yesterday and explained that they were still investigating the matter, but...... will cut her a check for approx $1700. In order to receive it she has to go in to the branch and sign a "receipt" Her lawyer drew up a paper that they are to sign stating that they still owe her the remainder of the $3500... Wachovia gives no real explanation of whats going on except that there are over 40 people in the same situation and that they are still investigating the missing funds!!! Sound strange right! All I can say is that i will never be banking with Wachovia!

Thanks Beli! After reading your post, it seems as if she may have to wait up to 90 days? Where did you get this from? Ill definitely let you all at CB know the outcome of this matter. Thanks for the comments and suggestions. If anyone thinks of anything else. we would greatly appreciate it!

Update. The money was taken from her checking account electronically......she had another meeting with her lawyer this am and basically the situation is still at a standstill. Wachovia says they will cut a check on day, but then they dont!

which begs the question of which is more important...friend/relative/acquaintance or the missing $3500. If it is me, even though we are only talking $3500, friend/relative/acquaintance can deal with the consequences. I don't just give money away. And if they were that close to me, they should have asked. Abuse the trust, go to jail...do not collect $200 (or the interest on my missing $3500). Let me clarify....she did file a police report. When i said she didnt want to go that route, i was meaning the suing of the bank. Her attorney wants to sue, but she is more interested in just recovering her money. She feels like if she does sue it will delay the process and she really need her $ back asap!

Hello CB! Long story short, a friend of mine banks at Wachovia. She discovered that approximately $3500 had been taken from her checking account. The bank is aware and they say that they are investigating the situation. Apparently this same scenario happened to several customers at the branch (located in VA). Does anyone know how long a bank has to return the money back to its customers in this type of situation? The incident was over 40 days ago!. The bank keeps saying it will cut her a check but then backs out saying they have to further investigate the matter. She does have a lawyer. The lawyer wants her to file a police report and sue. She really doesnt want to go that route. She just wants her money returned! If anyone has any advice she would appreciate it! THanks!
