Hello,

 

I was in a car accident 2.5 years ago and the health insurance company paid $4500 in medical expenses. I received a personal injury claim from the car insurance company, and the health insurance company wants me to reimburse them from this money.

 

The health insurance company (Anthem Blue Cross) has a somewhat associated "Recovery Service" called Meridian, which attempts to collect in this case. Meridian sold the account to a CA.

 

The CA sent me a list of the charges that add up to $4500, which they obtained from Meridian.

 

I opted out and sent the DV letter to the CA. Meridian also reduced the amount to $880 after I provided a letter saying that many of the medical expenses were not related to the accident, and Meridian then notified the CA of this change. I'm not sure if I should have talked to them at all.

 

My question now is, if I want to use the HIPAA letter to pay the $880 bill, who do I pay? It's not really a medical bill, but a reimbursement for medical bills they already paid. My understanding is that they are legally able to ask for this in my state from the personal injury settlement.

They are legally able to ask for it in any state. Health insurance policies contain a clause called the right to subrogation. That means if you recover your medical expenses as part of a suit or settlement for care they paid for you have to pay them back. You do not get to double dip so to speak.

 

If Meridian can prove they legitimately own the debt now you pay them. I would do so in writing making sure to get a statement of settlement IN FULL, that no report to CRAs will be filed from whom ever you pay this off to. You want to pay who you are legally responsible to not just anyone. I would start with the insurance company. If they own this CA then you are essentially paying them through their in house collection arm.

I do not believe that this is a legitimate claim.

However, since it relates to medical services, it IS covered under the HIPAA regulations.

To prevent it from appearing on your credit reports, I suggest you follow the initial steps here:

Since it is not yet reporting on your credit reports, then the medical DV to the CA is the most appropriate method of determining exactly what is being claimed and for whom.

The medical DV is adaptable to your circumstance and IF they respond with complete documentation of a legitimate claim of reimbursement charges from your accident, AND if their claim matches your records, then you can pay the INSURANCE COMPANY with the HIPAA letter insert "a". This will prevent it from being reported as a "paid" collection.

Thanks. I have not deleted old addresses, as they seem to already have my newest one. I can start the process to have old ones deleted.

 

I opted out and sent the medical DV to the CA over two weeks ago, CMRR. I am waiting to see if they respond.
