CA got checking acct. -- but I never heard of them!

They took $125 from my checking account on the 6th of April. The check was made payable to NCA 1-888-270-1572 in regards to an old account for EZMONEY loans the check was electronically drawn up and deposited at First Premier Bank.

My original principal on the EZMONEY loan was $250.00 with a payback of $305.33 -- I took this out in September of 2011 and had to cancel my old checking account because they [EZMONEY] continued to try and pull money from my account. I never gave anyone but my employer my new account information, ever. And here we are months later and I get slammed by some collector for $125.00!

I filed a police report immediately after finding this and they're placing it as forgery, I am going to the bank on Monday but I don't know what to do.

Any further advice, any one deal with this before?

BTW; I'm in Texas and they are in fact, bonded in the state of Texas. :glare:

Change your checking account number and put your money in another bank, for starters.

A collection agency cannot take money from your checking account without a court order.

call the bank, and find out why they allowed it.

check your local court online dockets to see if you have a judgment.

Holy crap. The account that was supposed to be closed and the bank told me was closed, was never closed. Somewhere the bank made an uh oh and the new account has been inactive. So there's that.

I checked Denton county court dockets and no information under my name. So I am assuming they took the old voided check digitally made one up on the computer and bam I'm out $125.

I just haven't received anything from anyone about this money.

If I'm not mistaken, we're dealing with an Illegal payday loan.

OP:

Go into the branch tomorrow, and start talking to the branch manager. Let them know that you closed that account years ago and demand a reversal of said money. Also let them know that you are under no certain terms paying any money on this account in either overdraft fees or trying to bring the account current. Nca is notorious for buying illegal payday loans. Also file complaints with Ks AG and their bank regulators. Stay OFF the phone with anyone other than the Branch manager or Executive offices of your old bank (if they are still around and haven't been brought out by someone)

I'd also write a strongly worded ITS letter to NCA Ceo.

Also file an ethics complaint here: http://www.acaintern...plaint-209.aspx they are a member of this organization, how they stay a member I have honestly no clue. However recent posts suggest that ACA is no longer helping consumers with ethics disputes but it wouldn't hurt. Whats even more laughable is if you look on their website (I won't post the link here) there use to be a big message saying they are working with the FBI on their illegal payday loan collections.. umm yeah right ah huh.. sure ya are buddies.

What happened was you probably signed a wage assignment without realizing it when you took out the illegal payday loan. These documents are also notorious with illegal payday lender outfits that supposedly gives them the right without court order to go into your accounts/and or to your employer and get a wage garnishment.

Wanted to add.. checked their website again this morning and it was still there.. rather than post the website, I will post the link directly from the FBI there is a link towards the bottom of the article where you can file a complaint with Internet Crime Complaint Center via FBI.. wouldn't hurt to file a complaint there as well.. not sure how this process works since I haven't done it myself.

Also have a few more questions for you.. did you ever put a stop payment on these guys or just closed your account before the next payment was due?

Someone from a 866-995-8680 called my Aunt, who was a reference for pay days loans to tell her that he had a court docket # for Texas and I was going to be arrested for 3 counts of fraud. He proceeded to give her my name, full address, place of work (or former work whatever he had on file), and my dob/ss#. She called my mother in a panic today thinking I state troopers were going to arrest me this evening!

I've googled this number but can't find anything.

A payday loan company did something similar to me -- called my mom and told her they would have the sheriff come and arrest me. The only difference was, it was the OC who did that, so the FDCPA rules did not apply.

Same general topic, similar to LMorgan... I have done this "payday loan/advance" dance with a company from Delaware in 2005. I worked two jobs,at the time, 70-80 hours a week and I kept it up for almost 3 months.

Never again, as to payday loan. It is not worth it. I ended up having to quit White Castle (I was only 23 at the time) because my pay was being Direct Deposited to an overdrawn (thanks to the "loan") I had to close/have closed (WaMu I think?) . No more.

$200-something advance ran about $1200..

Also, of note: The State of New Jersey has declared this loan PREDATORY and has PROHIBITED it from being entered into within the State starting in 2006. Even if the "governing law" is from New Mexico, as I believe the loan I partook in was. Just an FYI.
