Okay...I'm about ready to do the pre-Hippa to all three. I've signed up for CCT, I've gotten hard copies of all 3 CRAs. Addresses have been disputed previously and I've opted out.

 

Now....this is coming off next fall (2010). Is it worth doing the whole HIPPA process or just try and pre-Hippa the CRAs?

 

Also...one CRA is showing this as "open". How do I dispute that or can I? It's out of the SOL and date 'opened' is 11/1/04.

EXPERIAN shows closed balance 395.00

 

EQUIFAX shows no status balance 395.00

 

TRANSUNION shows open balance 395.00

 

Only equifax shows "medical unpaid" in comments

 

All three list as collection account as type.

 

 

 

Also...on my equifax only...there's a 'medical unpaid' account with no account name (CA or OC listed), a partial account # (21XXXXXX), collection account, $151 unpaid.

Should I just pre-HIPPA that and hope it goes away?

If you have opted out and deleted old addresses whenever possible, then send the "pre-HIPAA" letter. Follow ALL the directions and list ALL medical accounts, paid or unpaid, known or unknown. Make sure that each letter to each CRA lists the medical accounts AS THEY ARE SHOWN ON THAT REPORT.

It is more than likely that most or all of these accounts will be deleted with the "pre" HIPAA letter.

TransUnion deleted the Collection ($395) with IC System after receiving the Pre-Hipaa.

Still waiting for Equifax to respond.

 

However..today just got back results from Experian - came back updated and verified!!

It's due to come off May 2010 - should I just leave it and wait for it to fall off?

I don't have money to pay it off right now and do the insert A letter, so can I DV the CA?

The next step is to send the medical DV to the reporting CA, wait until you receive a response from Eq. as you would need one letter for each CRA where the CA is reporting.

Okay, sent out dispute to the CA. Got both the green card AND the response TODAY!!

 

IC System has a letter showing the doctor's name, principal due: $275.20 with collection charge of $120.58 with total balance due of $395.78. Letter reads as follows:

"Your creditor, Doctor's Office MDPA, has provided the attached information, substantiating your responsibility for payment of the above referenced debt. If you still question that responsibility, contact our office immediately, otherwise your remittance of $395.78 is required. Write your check or money order payable to I.C. System Inc and write your account number on it."

 

Attached is a two page letter from the doctor's office from 2007 (apparently I had questioned this awhile back, but never received it. It says "This letter is in response to an inquiry by (my name) regarding a debt dating back to 2003. This debt was incurred at (Doctor's Office) while the patient was under the care of (doctors' name).

 

The following is an explanation of the debt incurred, plus the addition of collection charges fee added."

 

Long list of different dates, charges, minuses, explanations (ex: hemogram, payment, debit adj transfer), dates not in order.....makes no sense nor does it show a running balance.

 

Then it says:

 

"The collection fee is based on the fee that the collection agency charges our office to place accounts and to collect overdue debts on our behalf.

$275.20 original debt amt.

x1.4085 = $387.62 plus $8.16 ($395.78 minus $275.20 equals $120.78)

Total new debt = $385.78 includes collection fee

The collection fee is 40% on the 1st $50.00 and 20% on the balance of the account.

 

If there are any questions regarding the collection debt, you may call our office at (dr's office phone #).

 

This is a valid debt with collection charges added. Payment can be made directly to IC Systems or to our office at (dr's office address)."

 

Do I still send the follow up dispute with the CRAs? What do I do now???

 

btw.....it's out of SOL, the letter states teh debt is from 2003, but they have posted the collection fee on the list of charges as of 10.27.04, so this 'should' fall off in 2010. Do I keep fighting or wait for it to drop off next year?

Do you remember when or how you questioned this bill with the OC? Did you do it in writing?

It seems really strange that a bill from 2003 would be questioned but the OC's response is dated sometime in 2007, anyone can post date a letter.

I would send the OC this http://whychat.5u.com/hipltr.html, and use insert "B"

 

"It is not a valid bill and has been properly disputed, therefore I request complete deletion from all your agent (name of CA)'s records and archives."

 

Then follow Why Chat's Hipaa Process from that point, please note the process changes as far as the next steps once you contact the OC.

You may send the follow up dispute to the CRA now, as you have not received a valid response from the CA, but personally I think the Hipaa letter to the OC is the best way to go.

It was only deleted from TransUnion. Both Eq and Ex 'verified'.

 

I was thinking I needed to dispute with the CRAs now, and send the insert "B" to the OC as well?

Pay the OC with the HIPAA letter insert "a" for your stepchilds charges. You are liable for co-pays when someone is on your insurance.

As to THIS post, you need to send the follow up letter to the CRA's. Their response was NOT "valid"

If the account is still verified, then you need to send the CA this;

Do not use the underlined portions and use your State's SOL for medical accounts. 4 years under the UCC or 3 Years in some States.
