I just found out last Thurs that my wage has been garnished due to an allleged default student loan with is not mine.I never reiceve any documents, i was not aware of the garnishment until my last pay check was deducted $235 last thurs. I placed a call to Hr, they faxed me a copy of two pages documents with a complete different name, address.Only thing I recognized was my ss.HR told that there's nothing they do, I have to call GRC( General Revenue Corp). I called them, they asked me to faxed them copy of my ss, driver lic and paystub before they can help me.I feel uneasy sending a debt collector all that personal info about me.What should I do?.Thank you.

but....DO you owe a defaulted student loan?

 

 

that's going to be what's important here...you don't have to be served, etc...

 

I'm surpised your HR department would pay when the SSN and name, etc weren't a match...

Its entirely possible they served the judgment on the wrong person.

 

You need to find out where they original judgment is from, then get the court clerk to send you the complete copy of the documents.

 

You may then have to petiition the court for relief.

I remember reading somewhere that since these loans are guaranteed by the government they can get away with a lot.

 

In the paperwork they provided your employer there must be a different number to call, besides the CA?

 

I would be very weary of giving out all the information you list to a CA.

 

I am not sure what's the best path to follow.

 

Don't garnishments require some kind of judgement?

 

If you were never served any papers maybe there is still something you can do about that?

No (not Student Loan related garnishments).

No (not Student Loan related garnishments).

why would you send a CA your information if you do not owe the debt?

 

 

check your reports. may be identity theft, if so file a police report ASAP and place fraud alerts on the 3 CRAs.

 

get with the court asap, most have online reporting where you can check the records of a judgment and possibly get the number for whomever this was actually issued against as well as the OC that filed it.

 

start there. leave that CA in the dirt where they belong.

 

your HR dept should be on your side, go about their heads, if possible & explain that nothing matches but your SS# and that's NOT proof of anything but identity theft.

No court order is required for admin wage garnishment....so going to the courts is a waste of time.

 

GRC is a vendor for the US Department of Education and several FFELP guarantors. You will need to fax the required information to get the guarnishment stopped....no other choice.
