The medical bills. Which he did, however, the OC never switched the account into the guy who assualted my husbands name.

 

This was YEARS ago. CA just sent bill to my husband.

 

Husband has been fighting this for years - it is supposed to be off of his credit because service was done over 7 years ago. How do we FINALLY close this account?

Generally speaking, on a restitution case, the funds are to be disbursed back to the victim (or sometimes the victim compensation fund). It is unusual for a Court to direct that the specific payments go from the offender to the provider.

 

If there is an outstanding balance, it may be worth seeing whether there is a provision for reimbursement from the Crime Victim Fund (or whatever name VicComp has in your State).

 

In the interim, I would go back to the provider and get copies of as much of the file as possible, both billing and service. You want to be able to document the link between the service rendered and the criminal judgement. Having a certified copy of the judgment would not be a bad idea either...
