Hey everyone,

 

I am at my wits end...

 

I had a medical collection go from the medical office to their billing company. Their billing company then sent it to a CA...

 

I filed BK 7 and medical debt was discharged... so balance is 0.

 

CA has it reported as BK 7, balance 0 on my credit report, it is also listed as "MED1"

 

Called medical offices billing company and was asked to pay the bill after the BK injunction - violation.

 

Neither the medical offices billing company or the CA will budge to remove it from my CR...

 

How can I get this off my CR?

 

HELP!!!!

Opt out and Delete old addresses if possible.

Send medical dispute letter on Whychat's site to the CRA's.

Dear CRA,

My name is xxxxx xxxxxx , my SS # is xxx xx xxxx.

I am sending this dispute certified mail # xxxx to make sure you receive it.

Please advise me as to the name and address of the medical provider, the date and type of service,and to whom the service was provided.

If you can obtain this information, I also would need the name of the person providing this data, and the manner in which it was provided in order that I may pursue additional legal remedies.

Make sure you HAND ADDRESS the envelope, use personalized stationery and purple or teal font, ( preferably italic).

 

DO NOT send it RR -WAIT FOR THE FULL RESPONSE FROM THE CRA(30+5 business days) BEFORE CONTINUING WITH THE HIPAA LETTER PROCESS

But I have disputed it with the CRA 4 times, each time it comes back verified in 3 days...

 

This CA is an AS******

You disputed using the medical dispute letter on Whychat's site and it came back verified with the info in the medical dispute letter or verified with no info requested. Did you redispute with the filed FTC complaint and still nothing?

 

Or did you just dispute the medical collection account as any other account on your CR?

I disputed it as erroneous...

 

It is listed as "MED1" on my CR, so it is coded...

 

When was the last time you disputed this? I would suggest you dispute it using the medical dispute letter on Whychat's site as that is the initial step in the HIPAA Process, especially if you want to go this route.

Did you read the link provided in the previous post as to what to do if in fact the accounts are fully verified. I believe it's Post#4.

Ok,

 

Sent the first letter off this morning...

 

I am betting it will just come back as "verified" and nothing else...

If it comes back fully verified with the info requested in the medical dispute letter, then you would move on to HIPAA letter insert "b".

 

If it doesn't come back fully verified with the info requested, you will have to file an FTC Complaint and redispute.

 

Either way it goes, this is a process and takes a little longer than usual, but great results are possible and I can certainly attest to that.Please remember that nothing in Credit Repair is guarnteed and what works for one person may not work for another and vice versa.

 

Keep your head up and be persistent.

Ok, sent the pre-HIPAA to the CRA...

 

Got a letter from the CRA stating to contact the CA for this information...

 

:)

 

Has it been 30+5 business days, if not then what you got was an "automated" response. Wait out the 35 days before proceeding to the next step.

Ok, filed the complaint with the FTC this morning via their website.....

 

Sent copy of complaint along with new dispute and copy of old dispute to TU...

 

We will see what happens...

Ok, I got the email for the FTC today.....

 

It contained a response.txt document...

 

It was a boiler-plate document...

 

It doesn't even look like they viewed what I had to say in my complaint????

 

So......

You have missed the whole point of filing an FTC complaint.

 

OF COURSE they don't "do anything", that is not the reason to file a complaint.

 

OF COURSE they send out an automated "boiler plate" response. That is all you will get from them.

 

If you are filing a complaint against a CRA the complaint will be added to their "score card" of complaints. The only way they can reduce their "bad score" is to take care of the problem and notify the FTC that they have done so. That is the reason you send the CRA a copy of your filed complaint.

 

( Filing an FTC complaint against a CA is a different ballgame, once they reach a "critical mass" of complaints they DO take action) :cry2:

Do I continue to dispute the account with the CRA and everytime they refuse to do a reasonable reinvestigation, file a dispute with the FTC?

You sent the "redispute" 3 days ago, perhaps you could use your time learning some meditation exercises and practicing patience. <_<

Yes, 3 days after filing a complaint with the FTC and sending a copy of the complaint with a new dispute to TU, I get a letter from TU stating:

 

Re: Dispute Status

 

Our records show that your creditor previously verified as accurate the items that are listed below. Therefore, under the Fair Credit Reporting Act, we consider this dispute frivolous and we will not reinvestigate the item.

OK, I am sorry but I had lost track of your thread.

 

You have done everything right EXCEPT following up with the HIPAA letter to the OC with insert "b". You should add to the HIPAA letter insert "b" this phrase. "Attempted collections by you through your agent (name of CA) on an account that was included in my BK # are a violation of Federal Law and subject to additional penalties"
