Long time lurker here, I just recently made a couple of post, but no real questions yet, so please bear with me. DH filed Bk in 9-05 most of the accounts were medical, all are reporting IIB, but from what I read I can dispute this with the hippa process using insert b,is this correct? Any advice would be greatly appreciated.

You send the CRA's the medical dispute letter from Whychat's site FIRST.

Thanks so much for your reply. I just realized that the bills were for treatment for his ex-wife. They were married at the time and insurance was in his name. So my question is do I still go for hippa process or DV them? Who would have been responsible for the bills?

Your husband had the legal responsibility, if you opt out, delete old addresses and send the medical dispute letter you SHOULD get a deletion.

 

If the accounts are completely verified, with the name of the OC the dates of treatments and the name of the PATIENT, ( x wife), you then have to see if THOSE accounts were also IIB. They would be listed on his BK schedule if they were included, if they were NOT included, you will have to check with your BK lawyer to see if they fell under the "automatic" inclusion rules or not.

 

If they were included in the BK, then you send the OC the HIPAA letter, insert "b" with the data on the BK and advise them they are in violation of the BK laws for attempting to collect on the account.

Thank you whychat. They are included in the bk, checked creditor matrix this morning. I have one more question. When I went through the file this morning I noticed that the OC sent a detailed account listing before this account went to collections, this listing included all information such as patient, dates of service, as well as what the patient was seen for and whether or not a prescription had been prescribed. DH and his X were separated at the time and there was no reason for a doctor to give him that much information. Is this a violation of hippa? Just wondering? I'll get started this weekend on the letters. Already opted out and I have been working on addresses.
