Updates:

Equifax: waiting on follow-up dispute results (will be submitting the split file dispute letter once the results are in)

Experian: waiting on follow-up dispute results

Transunion: verified the only medical CA left from follow-up dispute (trying to come up with funds to submit payment in full to the OC)

 

Question:

The medical CA reporting two accounts only to EX has removed the TL. However, they did send a statement showing my insurance, however the medical issue was a result of a Worker's Comp claim. Do I still send letters to the OCs advising them of the Worker's Comp claim?

Do you have any EOMBs from your WC claim to send to the OC with the HIPAA letter insert "b"- 1, or 2?

I'll have to search for that. I can probably access my old insurance account online and get it. I wonder if sending them the Worker's Comp file# and former job contact will help too, in case I can't locate the information. I'm sure I have it, but moved a couple times since this happened.

Updates:

 

Experian: Received a credit report along with a notice advising they will not investigate any further disputes regarding Meade and Round Two unless relevant documents supporting my claim are provided. Two medical accounts were removed by the CA, but checking to see if I have any EOMBs in relationg to these accounts. They are worker's comp claims. Round Two is Worker's Comp claim too.

 

Equifax: Sending off split file letter tomorrow asking for correction. (FYI: My DH has a CFPB a complaint against Equifax for several issues that seem to be related to a split file. There were disputes never being closed out and a BK reporting two different addresses depending on if you check Equifax.com or receive the credit report via US mail. He has suggested this in previous letters but it was never corrected. Two of the accounts he listed in the complaint were CAs and they appear to have been deleted. Equifax so far verified the BK, and left both addresses the same. He's awaiting Equifax's response to CFPB. This will be interesting to see what they say. He provided screen shots as well showing what the Equifax website displays compared to the hard copy.)

 

Also, although I have stirred the pot with the one medical CA (from the birth of my daughter), not sure if I'll be able to come up with the funds to pay the OC. I probably should have left them alone. I loss my job do to my difficult pregnancy, not to mention the medical issues afterwards. My unemployment is really taking a toll now, but I have to try to get my credit report in order. This is major factor contributing to me still being unemployed.

In addition to the above update, I received a supposed "investigation result" from Round Two. They advised that they are providing "verification" of this alleged account, but there NONE. The only thing they have provided is a listing of things such as is my last known billing address, which of course they have since I sent them the hipaa letter. The list also contains the following:

 

The OC name, phone number, address, and very interestingly they have the "Name of Current Creditor" name as Pendrick Capital, address, and phone number. Pendrick is a debt collector.

 

They go on to say for further information to write or call Round Two - which is what was done. They are a joke!!!

 

Remember: this is medical collection is a result of a worker's comp claim. See the funny thing is my former employer is a heavy sponsor of the hospital that I went to. This particular medical collection is from the emergency group who provided my medical assistance at the hospital. I recall the hospital staff telling me I did not have a worker's comp claim. wasn't until I went to a specialist about my injury the hospital referred me to, and the nurse there told me I indeed have a worker's comp claim.

 

???? It's clear to me they have nothing. I have my worker's comp claim numbers (from state bureau and former employer). Should I just send this information to the OC along with the final hipaa letter? (Along with the proper contacts who assisted in my claim - such as my former employer contact and their insurance information).

HMMM-- I think it might be a good idea for you to reach out to your State consumer protection department and get some help. Also contact the WC Board for assistance. It seems to me that there are a lot of violations going on here and perhaps your hospital's billing procedures should be audited.

 

OR, you can send the OC the HIPAA letter insert "b" with all the data and add the State WC Board to the list of agencies where you will be filing a complaint.

If it is more than 4 years since the date of service you are beyond the legal SOL for being sued and the "lawyer" threat is an empty one ( and illegal).

 

WhyChat, how did you get 4 years?

Medical accounts are covered under the UCC ( Uniform Commercial Code) SOL in all States, 4 years except in those that have a shorter 3 year SOL.

 

Can you point me to where I can read up on this directly from the UCC? Thanks.
