I sent TU an ITS letter. I sent in a dispute with about 6 items. They either verified or deleted 5 of the items. I sent another letter demanding deletion, but received no response to that one either, so I sent the ITS. I just pulled wk and don't see the collection listed anymore! It was listed yesterday! YAY!! No more collections on TU now!

Great job! Anyone that smacks TU around is alright by me! lol I DESPISE TU.

When I sent an ITS to TU, I had at the time 10 items in dispute.

Mysteriously, they decided that the time was right to delete 7 of them. I wonder why....

Sent them my "newest" ITS on Friday next day air. I should be hearing from them this week-I'm demanding damages this with one. I've had it with their pseudo reporting system.

Thanks! I am thinking that I will probably clean up my TU report first now. So far it is my best score, though still low at 542, but it 509 one month ago. They are listed on neg TL twice on my report. I just sent a general letter stating I don't have 2 accounts delete them. Guess I will also send a ITS for that one also if they don't correct it. I still don't understand one thing. They list a chevy chase card on the wk and myfico site - but it is never on the report I receive in the mail - nor the privacy guard site. I will assume it affects my score on myfico since it is listed there. I did dispute that TL - should ITS that one also. This is exciting now - to watch the stubborn ones come off.

Thanks again. And - good for you also! I know what you mean about their reporting system. I disputed 2 items recently and all they did was lower the amount that was still outstanding. The problem is - these accounts should have a zero balance. I sent procedurals out on them, so we shall see what happens there.

Yay!! Congrats :D So, you sent an ITS letter b/c they werent investigating that one collection? I guess I didnt understand your basis for sending the letter....

I wish I had the nerve to send an ITS letter....it's getting to that point though with those stubborn TL's! I'm just afraid to get myself into trouble LOL I've never been to court except divorce court and I really didnt have to do anything but show up

Is your report coming straight from TU in PA?

I'm having a similar problem... my CR comes from CA.

I despise TU

Edit: Oh, and congrats

Yes, I sent the ITS because they weren't investigating it - just ignoring my request.

It wasn't so much nerve that made me send the letter. I was just aggravated becasue they were ignoring me. I just felt like I had no other choice but to send the ITS. I couldn't dispute it again cos they would probably tell me it was frivolous. I didn't want to waste another 30 days waiting for a response. I am patient to a slight degree. :)

Do you think we might be able to see a copy of your ITS?

Sure, here it is. I don't remember who to give credit to - it was either here or credit net that I got the letter from.

RE: Dispute Letter of xxxxxx, Follow-up Letter of xxxxxx

NOTICE OF INTENT TO FILE COMPLAINT

Dear Sir/Madame:

This letter shall serve as formal notice of my intent to file a complaint with the FTC, due to your blatant and objectionable disregard of the law.

As indicated by the attached copies of letters, you have received and accepted through the mail my dispute letter dated xxxxxxxx, as well as my follow-up letter dated xxxxxxxxxx. To date you have not done your duty as mandated by law. Your non-compliance with federal law is unacceptable, your disregard for it contemptible. Rest assured I shall hold you accountable.

Federal law requires you to respond within 30 days, yet you have failed to respond. Failure to comply with these federal regulations by credit reporting agencies are investigated by the Federal Trade Commission (see 15 USC 41, et seq.). I am maintaining a careful record of my communications with you on this matter, for the purpose of filing a complaint with the FTC should you continue in your non-compliance. I further remind you that, as in Wenger v. Trans Union Corp., No. 95-6445 (C.D.Cal. Nov. 14, 1995), you may be liable for your willful non-compliance.

For the record, the following information is being erroneously included on my credit report, as I have advised you on two separate occasions.

Name of Creditor/Agency, xxxxxxxxxxxxxxxxx

If you do not immediately remove this inaccurate and incomplete information, I will file a formal complaint with the FTC. Shoud you continue to operate with complete disregard for the law, I intend to seek redress in civil action for recovery of damages, costs, and attorneys fees. For this purpose I am carefully documenting these events, including the lack of response REQUIRED under law from you.

You are further directed to supply a corrected credit profile to all creditors who have received a copy within the last 6 months, or the last 2 years for employment purposes.

Additionally, please provide the name, address, and telephone number of each credit grantor or other subscriber.

Under federal law, you had 30 days to complete your re-investigation, yet you have failed to respond. Further delays are inexcusable.

Be advised that the description of the procedure used to determine the accuracy and completeness of the information is hereby requested as well, to be provided within 15 days of the completion of your re-investigation.

Sincerely,

FYI The above letter is from Credit Net and is an intent to file a complaint with the FTC for not investigating.

Wenger v. Trans Union Corp., No. 95-6445 (C.D.Cal. Nov. 14, 1995),

Wenger v. Trans Union

"In 1996, CLIPI prevailed in Wenger v. Trans Union, obtaining a record setting verdict of $200,000 for a victim of credit "identity theft" as well as the nation's first court order compelling a credit bureau to clean up a consumer's credit report. This case -- covered extensively by the national press -- paved the way for a nationwide discussion of the rapidly escalating problem as well as CLIPI-authored Assembly Bill 156, extensively reforming credit bureau practices. AB 156 was passed out of the Assembly on a unanimous vote."
