Interesting article, not sure if posted before. But ACA had this posted in a interview. Use it against them if you wish! It apears they are trying to weed out the NCO's, Asset, and other repeat offenders. Could be bad in the long run, but in the mean time, jump in on it!

 

"ACA's Code of Ethics

 

Under Rule II .A3 of the ACA Code of Ethics, association members are required to provide verification of a debt or cease collection activities until such verification is provided, regardless of when a dispute is sent by the consumer. Therefore, members need to honor verification requests after expiration of the FDCPA's 30-day validation period. Members may also provide verification based on a consumer's verbal request, however this is not required under the FDCPA or the code of ethics. Though the new requirement does place some additional duties on ACA members, the Ethics Review Task Force decided the new requirement was essential to improve the industry's image in the eyes of the public and regulators."

excellent information...

 

while it doesn't carry the weight of law...since some CAs want to remain members of ACA, this could be very useful

I used to report CAs to the ACA quite a bit, and haven't done it lately.... might have to rethink that! :lol:

I just did with Norhtland Credit. They are a member of ACA. I tried resolving it with the school to no end. I paid the school directly a past due amount that this collection agency has, and was told by not by one, but two people including the head of administration that my account would be RE-CALLED from collections, yet it marked "Paid". I also sent in a CMRR to them, which they have yet to respond to. So I filed a ACA complaint against them. ACA gave them 30. I faxed ACA the letters I sent, the e-mails I have sent and also the receipt FROM THE SCHOOL showing I paid them directly. I told them yes, I knew the CA had it, but however I paid the school directly, and having the CA marked paid, when it should have been recalled is deceiving and unethical. Not to mention that anyone looking at my reports would see I have a "paid" collection when it's not true, that I paid the school directly, and that it cost me 20 points and possibly a mortgage loan. (which is true, once that paid collection hit, my score went from 633 to little over 600).

 

I have all the emails, to the school, CMRR letter, what I don't have any more was the original bill. I never disputed it because they were collecting on the correct amount, and at the time I didn't know better. (Before CB). Should I need to take this further, if ACA doesn't solve anything.

 

And Yes I have a dispute going with the CRa (TU & EQ) will be interesting to see if this comes back verified.
