I followed your guidelines and was very successful in having the CRA delete 3 medical bills. However, I have a few remaining. So my question is regarding SOL on these medical bills, When Does It Start? or should I be to concerned since none of them are over $700.00 except for one at $1800.?

 

Example on SOL: Admitted in Florida Hospital 5/2/01 discharged 5/4/01, Insurance applied 6/30/01, final bill sent on 9/30/01 date opened with CA 2/2002. (No payment ever applied to this account)

 

Same scenerio with 3 other medical bills non-hospital. Also, medical bills are from Florida and Mississippi, I currently reside in South Carolina.

If the medical bills were deleted from your reports it is because the CA reporting them had NO VALID ACCOUNT.

 

The hospital likely wrote off/discounted any balance and you owe nothing. :P

Thanks for replying... but I wasn't clear in what I am asking you - my question is for the remaining medicals that are still listed on my credit report which are (as above stated), a hospital bill, some medical, etc... when does the statute of limitations start? (i.e. time of discharge, time of billing, date sent to collections?) What should my next strategy be? And, Should I be concerned of waking the sleeping dogs when, IMO, the SOL is only a few months away, and the debt is so small?

I thought I read that the SOL starts on the day of service for a medical debt.

I'm sure it was in this forum........but um.....I've slept since then.....lol :blink:

OK- here is my advice on ALL medical bills on your reports.

Forget about the SOL ( 4 years UCC on medical bills) it is a NON ISSUE.

 

Send the medical dispute letter on any accounts that are on your reports, IF the accounts are COMPLETELY verified by the OC through the reporting CA to the CRA, PAY THEM!!, ( of course with the HIPAA letter directly to the OC)

 

The ONLY time you need be concerned about SOL on medical debts is if you are being sued on a medical debt that you have NO OTHER defense on, i.e. "it's not yours,it was paid by insurance,or should have been paid by insurance if it had been properly billed,it was an inflated bill that you had disputed etc. etc." If you are being sued on a large medical bill, particularly from a Hospital, there is likely NO "useable" SOL defense, ( if that is your ONLY defense), as unpaid medical bills from Hospitals are paid, (reimbursed) by the State from taxpayer funds and the Courts have held that it is an indirect "Governmental" obligation.

Wooohhhhhh nelly ... Are you really saying that SOL is no defense? So for example say SOL is 4yrs and its been 6.5yrs .5 more and it comes off your CR, since it really has no SOL they can then at that time sue you or even further down the road say 17yrs ?

 

I really dont a clue when it comes to SOL and medical bills, but I did think they must surely have a definite SOL for collecting. If they dont then let me know - if they do could anyone provide a link for SOL by state regarding "medical bills"

 

I know there is a lot of speculation as to what category medical bills fall under. Surely there is a precise answer - no?

The SOL for medical services is 4 years under the UCC.

 

HOWEVER, if it is a hospital bill or a bill from a health care provider that is part of ANY "subsidized" Governmental agency, and you are SUED, and your ONLY defense is the SOL, you will likely lose in Court.

 

Obviously, if it is a bill over 7 years old, and it is off your reports, unless it a VERY unusual circumstance from a State or County Hospital, you are not in any danger of being sued.( There have been cases where someone has left the Country after running up a $20,000+ bill at a County hospital where they have been sued when they returned, however in those cases they had been ABLE to pay)
