  1. Anyone familiar with credit card disputes for purchases, chargebacks? Purchased something from a .com and my order never came- someone elses's did, alright. The .com did not have a # on the invoice nor a # on their website. The box didn't come directly from the .com but rather their vendor/supplier for the product. I did the email for help but they had a default message sent to me that did not help. Went to a brick and mortar store who said they couldn't assist because it didn't come from them-came from a vendor. Disputed w/ my bank and received a provisional credit. Provisional credit reversed yesterday because the .com sent a copy of my invoice. Of course they have an invoice...that wasn't the issue. My invoice was slapped on the wrong box. How do I prove this? My bank is giving me credit again today but said the .com has a chance to respond/rebutt with VISA. What would you do? I do have 2 people willing to do sworn affidavits (they knew I ordered it, knew it didn't arrive, and knew the pain it caused when the .com wouldn't address the issue, and knew I had to purchase it somewhere else) Thanks! This is over 500 bucks we are talking about! Are there any magic words....I've used things like "never received item ordered" "wrong item sent" "contacted merchant many times" what else?
  2. Many ask this question, or just wonder "what if I stop paying my creditors" I felt no other way out so that's just what I did. ONE YEAR later results: Not checked my credit file- not even once. Pay auto insurance in 1 time premium every 6 months (won't be able to switch carriers for many years to come) My home is in my daughter's name with all utilities, too. (couldn't get cable in my name if I wanted to) Have a prepaid cell phone - Virgin Mobile (couldn't get a 2 year plan w/o substantial deposit) Have magicjack - so the home phone has been no problem I don't leave any bags or anything in the car due to the repo man could come at any time (it's been a year since my last payment) When I shop, if I don't have cash- I don't buy. I'm not able to rent any car due to no credit card (won't even try it with a debit card) What shame I felt when I made the decision to walk away, but it felt like that's all I could do. I lost everything including condo and 2 other cars- to leave everything to care for my dying mother. Now, a year later- it's weird in a way. I'm less stressed. Hopefully over the next 6 years I'll modify my behavior enough to never need credit because clearly I wasn't responsible enough. This isn't recommended, at all! You will ruin everything by just walking away. I am unemployed and live with a cat- don't end up like me!

Did some major digging in manuals (online versions) with some key words you've mentioned and found: in December of 2003 a directive saying all past debt balances must be ZEROed out... I also found another directive saying any overpayment notice is to be sent "by the 2nd quarter after the overpayment was made".... and another directive saying any wage garnishment or involuntary repayment must be done thru a Civil Judgement thru the court. It further says the household can inspect and view the entire file to see how the overpayment happened and if it was county error, it's not collectable. So, a 1994 debt....I'm gonna keep to my claim that this isn't mine AND I have the right to get signed contracts, copies of the checks - front and back- of things they said they paid me. I simply just don't remember that far back. And this very well could belong to someone else. The only difference between my name and that of 2 other family members is an A...placement of the a in the name. Could be theirs.
  4. Unemployment? Hmmm...... I did receive unemployment from 1990-1991. But not since. And since they won't tell me what it's for...I have NO CLUE what the debt is for. this is North Carolina
  5. I recevied a billing statment saying I owed $555.00 in the OVER 90 DAYS PAST DUE box. under the description is says 5/13/1994 INV Due 05/13/1994 Orig. Amount $544.00 544.00 6/25/1996 INV Due 06/25/1996 Orig. Amount $11.00 11.00 "Failure to repay at least 10% of the balance monthly could result in garnishment of Federal and/or State Benefits, such as Tax Refunds or Social Security Payments." I mailed a letter of dispute basically saying I don't know who they are or what this is for...please send copy of the contract bearing my signature and an account history of billing and credits. I feel once you do the research you will find this bill in error." They responded with another copy of that statement and a letter saying this was for 'overpayment'. This all comes from my county's dept of social services I sent another letter saying I don't belive this alleged debt belongs to me and that they didn't provide any of the information. Since this alleged debt is over 10 years old and past the statute of limitations for collections...it's necessary for me to have: copy of contract, installment agreement, credit card application, or any other document used to create the debt copy of front and back of any and all payments (since this is 'overpayment') the account history.... Anyone? I don't know who these people are! And 15 years ago???? I know I got medical insurance thru the state way back when but I paid $77 a month but that was thru the state. Can they come after me after 15 years without providing me with anything showing it's my debt? Thanks!
  6. Get an F if you can't repay the benefit- if you are in school but something has happened to where you can't finish. You can always repeat the course to get a letter grade (some colleges have time lines so check first). But make sure you can handle one on your transcript or else it will haunt you.
  7. Will it? It already has begun where I live. Car break ins on the rise. People's sheds/garages/out buildings are broken into.... so far haven't heard anything about Burgulary or Robbery- except at stores.... a man walking out a Best Buy was robbed by a guy....

And to bash the other nut.... saw on the comedy channel a clip...the mad money guy had a caller who was asking about his stock in some BIG firm....the mad money guy did his body shaking/loud yelling saying that company is solid-been around a long time.... the caller wanted to take his money out but the crazy expert said to leave it in. Next week the company went out of business, or something like that and the poor man lost everything. Funny! Just do what you think is best and if you need money- don't give it to someone else even for growth. Have money you don't need for a year or two....keep is safer in a bank/cd or something. Have money you won't need for years and years...then go for some risk.
  9. There is light. I had over 100k in debt-mostly unsecured. Had 2 auto repos (voluntary) and just walked away from the debt. Yep, I was a renter and unemployed so what's the worst that could happen? But since then I've purchased a home (deeded in someone else's name) and have all my utilites in my daughter's name. I kept my car insurance and know I'm locked in for 7 years as nowadays they check credit when you want to get a new policy somewhere. Also I had to open a new bank account because I had loans with my bank. So, it's been 9 months now since I made my last payments. I am strictly on a cash only basis with all I do. I don't have a credit card and use my Visa Debit for everything. If I don't have the money to pay cash...I just don't purchase it. Very humbling experience. But I come across people all the time who just lost their jobs....my sister rents over at a nice complex and she has witnessed many moving out....the manager says moving back in w/ parents....and these are grown men and women. The economy is tough and is going to get worse. You've got alot of decisions to make. Be careful about the house.... in two names, sure....but most states consider married debt BOTH parties even if it was just one of them's name on the account. Just look into it.
  10. Great post. Just saw on the news where 30% of Americans are actually losing sleep because they are that worried about the economy. I cancelled my cable today! The news is always horrible AND I'm tired of the rate hikes constantly. I've never paid the same amount for more than 2 months...keeps going up and up and up. So it's back to the basics in my house. We played our first boardgame in years....time to knock the dust off the family fun.
  11. A car that was financed. Finance company had lien. A year later the finance company mailed the owner the title w/ the lien release and stamp. Owner moved a month later and took title to new state and got registration/plates when the original registration ran out- 7 months later. A week later new state's title came in mail. But owner thinks- knows- the balance of the loan wasn't paid but stopped making payments after title arrived in mail. What happens? Can the finance company repo when it discovers the loan isn't paid? Or does the release of the lien make the 'secured loan' an 'unsecured loan'? Or does the finance company contact the state and put their name as a lienholder then repossess? IF repossession process started- since the move the finance company didn't have the new address...but now that it's titled/registered in new state- owner is now on the grid.

  13. Not proud of what I did- but had to do what I had to do- Two cars repoed-voluntarily as I couldn't pay the bills. Was moving so I parked the cars at a casino and mailed the banks the valet tickets w/ my identifying info so they could find my account and the address of the car. One bank sent me a letter a month later saying my balance of the loan was about a thousand bucks because it sold for less than my loan balance at auction. The other bank has called and called all my relatives threatening police action. Did they not get their letter? But they did as I mailed it certified return receipt. What if they didn't read the letter or process it - as in the clerk who opens the mail just put it in a dead letter pile. I'm sure by now they either have it or my guess is the casino had it towed for being abandoned. (this was back in July) Am I supposed to try to locate the car for the bank?
  14. Hi, not sure about laws for certain states; however, I canceled the insurance the same day. In my state there was no law requiring insurance on a car that you do not own, operate, etc. And since it's repoed, the repo people now own/operate, etc. the car. Did a voluntary repo and when I parked it and turned in the keys - I cancelled the insurance when I got home. Oh, if you are going to get another car....I'd wait til you 'added' the car and then 'remove' the repoed one. This way, you won't lose your coverage. Good luck.
