Folks I need some assistance

I have 2 loans that have never had a payment made to them, both are over 10 years old.

Some how Pioneer credit is now doing something with these loans.

Pioneer has forwarded documents to me from this website:

http://loanconsolidation.ed.gov/

It appears they have filled out an online app and promissory note on my behalf, I have not authorized this in any way, and sent me the docs they printed of off the web.

Along with these docs they sent thier own authorization release for me to sign and return to them.

This has now started docs coming from Direct Loans, that state i have started an application process.

The 2 loans are from:

Sallie Mae Guarantee Svc

1) A-subsidized federal stafford loan about $11000

2) H-federal supplemental loans for students(SLS) about $9000

What do I do??

I have never been in a position to repay these things and I am still not really, I could manage to do something if somehow this saves me.

What they may have done is filled in the blanks on a consolidation...I don't recall rehab forms on that site. However, since they referred you to the ed.gov site, that suggests that both are not subject to SOL and Pioneer is who currently has them (instead of one of the state guarantee offices).

 

Spend some time on the ed.gov website and explore your options...the federal loans can have garnishment started without having to take you to court (don't ask how I learned that little tidbit). Rehab will give you a year of payments after which they lose the defaulted status and the credit report can get cleaned up...a straight consolidation without rehab leaves the derogs on the report.

Whoa!! Hold on here. What Pioneer has done is ILLEGAL!! This would be deemed third party disclosure under the FDCPA. Since you did not give your consent, they cannot share information with ANYONE!I would suggest that you call the Ombudsman (info on link)http://www.ombudsman.ed.gov/about/contactus.html. They should be able to verify that a collection agency cannot do this. Also call the Department of Ed to complain. It would also be advisable to contact an attorney.

I'm not sure if it is third-party disclosure when it was the feds that turned the loan over for collection and the information for the consolidation went back to the agency of origin.

 

The feds push consolidation very heavily in order to get their money back while generally saving the defaultee some money in the process through lowered rates.

Salimae turned them over to collections and Salimae is not the department of education. The student has a choice in consolidating with whatever consolidation loan company they choose
