Hi All! I have been working on my husband's credit in hopes of us getting preapproved for a mortgage soon. I have been lurking on these forums and other credit repair boards and read up on the hippa process and was successful at getting one medical collection completely removed from all reports. I have two left. I just sent my pre-hipaa letters for one of them the other day. The other I have been working on since the end of last year and need some help with....

Its a medical collection for $309 (from April 2009 according to my credit reports) that we never recieved a bill for. I started at the end of 2011 and followed all of the steps of the Hipaa process exactly. Transunion immediately deleted after I sent the pre-hipaa letter. Ex & EQ both responded to my pre-hipaa letter with generic letters basically telling me that the debt was valid and to refer to my credit report for the information I was requesting. I then sent the CA the DV letter on 12/14/11 and heard nothing back but finally recieved the green card after a bit of waiting. I sent the re-dispute letter to EX and EQ on 1/3/12 and have since gotten the green cards back. I have had no response from Equifax but I would periodically check their backdoor for updates on the account and it did say that it was being disputed for a while but as of a few days ago it no longer says that the account is in dispute. Experian did respond but all they gave me was the same information that is in my credit report for the collection account. I'm assuming that Equifax is sending a similar letter and it is on its way.

I'm not sure where to go from here. The credit report shows the OC's name and sounds legitimate based on medical stuff my husband has had done plus I can't seem to remember if my husband had insurance at the time because he had changed jobs often. So I guess it is possible that a valid balance is due BUT...Since we have heard absolutely nothing from the collection agency when we tried to validate the debt we are at a loss for what to do next. Any ideas? Thanks in advance for any help you can offer :)

Had you opted out

and deleted old addresses BEFORE disputing??

If not, do it now

Call the OC and find out if there is, in fact any outstanding balance that was billed to you. If they confirm that there was one ask if they submitted it to your insurance at the time. If they say they had no record of any insurance, AND they say there was a balance due AND they say they sent you a bill AND they had your correct address, thank them and get off the phone.

Yes, I opted out and deleted old addresses before disputing. I will have my husband call the OC when he gets off work and report back as soon as I can. Thanks!

Ok, I talked to my husband before he left for class and he called the OC. The lady he spoke to said that there was a charge and that it was billed to his insurance at the time. He was responsible for whatever the insurance didn't cover. Insurance paid their part. They sent a bill to the correct address (our old address) but we never got it apparently. He hung up and didn't ask anymore questions.

We moved December 30th, 2010 to our current residence but I don't know if that would make a difference because this was like 8 months later plus I had our mail forwarded to our new address and I believe the USPS forwards all incoming mail for a one year time period. We never had any problems getting any other mail.

Pay the OC hospital directly with the HIPAA letter insert "a" Follow all the instructions exactly.
