I sent a C and D to eCast settlement Corp. Now, they have sent it to POM Recoveries.

 

I am sending a copy of this letter to the FTC and my state attorney general's office immediately! This dun letter is not withing the FDCPA and they must pay!

 

Here is a quote of the body of the letter:

 

"This is a great opportunity to settle this matter amicably.

 

Our client (eCast Settlement Corp., which I C and D'd two months ago), is a very reasonable and understanding firm. Although they have authorized that we forward your account to an attorney for immediate lawsuit, they have requested that we contact you again in the hope that tyou might consider a reasonable arrangement. Please consider this opportunity to settle you account amicably. They are very willing to meet you part of the way regarding repayment of your obligation. If we do not hear from you within 10 days of the date fo this letter (June 13, 2002), we will have an attorney commence an action.

 

WE ARE A PROFESSIONAL COLLECTION AGENCY ATTEMEPTING TO COLLECT THIS DEBT. ANY INFORMATION WE OBTAIN WILL BE USED FOR THAT PURPOSE.

 

POM RECOVERIES, INC."

 

How many violations can you count? No 30 days to dispute, or anything like the mini-miranda. Sounds like the threat to sue is not-something that they can do.

 

Any moderators, maniacs or experienced ones count more?

 

If so, how should I approach? This is still within the SOL.

I would wait until around june 25th and then call and tape them(if they are in a 1 party consent state) while you ask if they commenced the action they stated they would.

I C AND D when it is out of state and a great distance for them to file in my local county court. Also, only if the amount is under $5,000.00. Otherwise, I know it is an invitation to a law suit.

But if you C&D them, how can they settle with you or promise deletion?

 

I always just tell them that I want all communication via written form, that way it creates a paper trail and stops the harrasment.

Ya well, I've done that before as well. Still got a summons in the mail. Even though I only asked for validation. I got partial validation and a summons. Nice huh!? Just trying to work it and they are trying to work me. :twisted:

Which state requirements do you mean? Fair Billing, UCC, Civil Code? Not sure?

 

The summons came with a copy (unsigned) of original loan docs. Applied online, so I don't know if they have a signature. Made payments for 6 months then medical expenses and the death of a family member sent things spiraling down financially.

 

I sent a letter to the OC 3 months ago regarding my situation. They simply wanted their loan payments made up, then they went to a collection attorney. It is a Credit Union. So maybe this is how they strong arm debtors.

 

Any advice is certainly appreciated! :lol:

This was from an attorney. Your sig link, seems to be guided more towards CA's. Can you direct me via link, to where I can research an attorney's office. I.E., bonding requirements, licensing, BAR License #'s?

I am willing to do any and all research, just looking for which direction to go...like a Credit GPS! :D

The link is fixed...the POM Recoveries needs to be properly licensed/bonded if required. In your post you stated they would "Send it to an attorney"...therefore...it's a CA
