Hi There,

I had two accounts on my wife's credit report which were reported as PAID. I followed the process as described by Why Chat and it worked. Here is the link http://creditboards.com/forums/index.php?showtopic=410142

 

Now I have one account on my credit report which was initially paid to CA and when i disputed account i received letter from CRA (Experian) that it has been verified before.

 

After that i followed the process by sending this letter to CA (CMRR)

and then follow up to CRA using this letter (CMRR)

I have green card from both and It has been more than 45 days and no response from CA and CRA.

Have you checked your Experian report to see if the account is still there?? And if it is, is it being shown as "in dispute"??

If it has been more than 45 days then you need to call Experian ( I KNOW I KNOW -NEVER CALL !!) be very polite and try to get through to a supervisor and tell them that you sent a dispute in on xx/xx/xxxx and have received no response and that before you file a complaint with the FTC you are giving them the chance to straighten it out.

Be sure to list ALL your correspondence as well as the phone call and state that the account is not being shown as in dispute, which is another violation. The biggest violation is their failure to respond within 45 days of their receipt of the dispute.

I called Experian. I could not get to Supervisor she transfered me to Voicemail. I left a message but no response yet.

 

While i was talking to Agent she said that Experian sent me a letter stating the process of investigation in response to my "Followup Letter". I did receive that letter on Sep 28th but did not get any letter or response after that. She said that they are not going to re investigate until i provide them more information. Why i am suppose to give them information.

 

Please help me out here.

 

So should i file complaint with FTC or some other process is needed.

Print out your complaint BEFORE clicking enter. Your complaint should list the actions you have taken,( with dates for each) i.e. filed a proper dispute on an unknown medical account, contacted the reporting CA with a dispute and request for validation on this unknown medical account as per instructions from ( name of CRA) re-disputed to ( CRA) with a copy of your dispute/validation letter to the CA, along with proof of the CA's receipt of the dispute. (CRA) refusal to properly investigate or properly mark the account as in dispute is a violation of the FCRA and FACTA. Send a copy of the complaint with another dispute to each CRA. Make sure that your follow up dispute to the CRA is addressed to their compliance dept. sent CMRR and includes this phrase; "I reserve the right to take further action including filing appropriate complaints with ( your State) 's consumer protection agencies, the BBB and to take civil action to recover damages".

Also while filing FTC complaint. Which company should i name for this question.

Do you know the name of the company/individual involved in your complaint, or do you have any other information about them?

There is no template for this "dispute" you are on your own....

You really just need a cover letter explaining the steps you have taken, dates you disputed, the responses to those disputes and actions you have taken with the CA and their lack of response.

You can get as technical as you like in this letter, but I think it is best to keep it simple.

I filed complaint with FTC on 6th Jan.

 

I just pulled my Credit Report today before sending follow up dispute to CRA. I am glad to report that Collection account is deleted and credit score is back.

 

Really appreciate help from this forum.
