A Recorded And Paid Medical Judgment

I have confirmed that I have a paid and recorded medical judgment on all three of my credit reports. I think I have a good understanding of the HIPAA letter program as it pertains to med collections, but can I apply this program to a paid recorded medical judgment? Does HIPAA require a paid judgment to be deleted from my reports just as a paid med collection does? I have already opted out and had old addresses deleted (well all but two), should I begin with this letter first? TIA!

Were any of the "old" addresses the address you were at when the judgment was filed??

Do you have a copy of the recorded judgment??

Do you have a copy of the recorded release??

 

HIPAA does not affect any legal actions in any way. Legal documents in the public records were exempted from the privacy rules of the HIPAA statutes.

 

IF you have a copy, preferably certified, of the recorded judgment AND the release showing that the payment was also recorded, then yes, you can send the CRA's the dispute letter;

You need to be aware, however, that if it is reporting as a paid/satisfied judgment, and if can find NO discrepancies between the recorded judgment and how it is being reported, and if your address is the SAME as when you were sued, and if it is less than 7 years old,( 5 years in NY)you will likely not have much luck.

It's unfortunate public records are exempt, I was hoping I would have protection under HIPAA. In any event, thank you for your quick reply and all of the info you shared...
