Hello all, I am seeking some advice. I had to take my son to an ER for an asthma attack while we were on vacation in WI. My ex carries the insurance on him.

I just got a bill from a CA for 489 bucks, and at the bottom it says "Ins sent check to insured. Balance due immediately". I called my ex about the supposed check and he denied ever getting a check from his old insurance. (he changed jobs and has diff. insurance now) I just by luck happened to still have the old ID card for my son and I called the number on the back. Not only do they show they sent him check for about 1/2 of the bill, they also show he cashed it!

So I placed another call to him, asking if he is sure that he didn't cash a check from the insurance company. (one last chance to own up) he still lied. Then I told him that I had just spoken with Anthem BC/BS and that he had cashed a check from them. His next statement? "why did they send it to me??" Geez. Then he says, "what do you want me to do about it?" My answer was that I would like him to write a check for this bill in the amount of the check he cashed. His answer was "I'll have to get back to you on that one." Which basically means no.

Is there anything I can do to get him to fork over the money he shouldn't have taken anyway?

Is he paying child support or alimony?? Do you have an insurance card for your child from his "new" insurance??

 

You probably have a legal claim against him for violation of the divorce settlement. You would have to see your divorce attorney or Legal Aide if you haven't one. You might have to file suit against him to recover damages.

 

Otherwise you have no other recourse. You will have to pay the bill and recover it from him along with your other costs, legal fees and damages.

Thank you for the reply! I contacted my domestic relations department in my county and am getting this taken care of. Worst case scenerio is that it gets added to his arrears in c/s.
