Hi,

 

I have a paid doctors clinic visit that is still reporting on my CR as unpaid to CA. I paid the doctors a while back. I disputed with the CRA's but, the CA won't remove and I have the receipt in my possession from the doctors office.

 

I'm now sending a HIPAA letter over to the OC (doctors office) with the insert B. I am also wanting to confirm that I'm not to do anything else until after I have the CMMR back. Is this correct? I'm finding by reading several posts it gets really confusing to me.

 

After that time I'm to send the CRA the HIPPA letter if there is no response within the ten days waiting period. Please help me to understand. I'm working on this and so far everyone has been very helpful in my search to my credit repair.

 

Oh, and just to let you know every one of my doctors CA has been removed from my report and this has done alot for me so far with regards to my scores.

 

This is the only other CA for medical that I have left and they are making me pull my hair out as I have disputed this account inaccurate for several times and they had the nerve to say they were reporting accurately according to the FCRA. Lol, and this is completely wrong as I have no outstanding debt with the doctors office.

You need to opt out, get old addresses deleted if possible and send the medical dispute letter to the CRA's BEFORE sending any HIPAA letter to the OC Dr.

 

Your Dr. may have NO relationship or communication with the reporting CA, therefore your HIPAA letter insert "b" will be useless.

 

ONLY if you get a COMPLETE verification from the CRA ( with a communication from the CA ) can you use the HIPAA letter insert "b".

Thank you I never got a complete verification from the CRA . I had disputed this account several times with them before so what should I send to them as they keep updating that this account is accurate?

Your prior disputes were likely either a "not mine" or "inaccurate".

 

All they do is match the spelling of your name.

 

Send the medical dispute letter.

Just a quick question Whychat. If the CRA responds to the medical dispute letter, isn't that a violation of the Hipaa in and of itself? Or is the CA, acting for the OC, not bound by those laws? I have disputed a medical several times and was going to send a letter to the OC asking them to remove. It was for a dentisit's office. When I realized there was a balance due, I paid. According to my report, it looks like I paid after it was sent to a CA, but the office said that they would "take care of it". I do not know if it hit my reports before or after payment. AND, just to play devil's advocate, another board said the HIPAA route does not work. They suggest simply paying for a delete. I have no baddies left on my report besides medical. Though several of them I cannot pay in full, there are a few small ones that I can. They are rather new, so I believe they are within SOL. I have removed what old addresses I can, and opted out. Why do you think the PFD will not work? How many others here have had luck with the HIPAA letter? It sounds very legal to me. It is sort of like pointing a gun at a robber. If you are going to do it, you better be willing to shoot. If the OC's do not cooperate, you'd better be ready to send a letter regarding violations. If I do this, I don't want to do it half a$$ed, know what I mean?

 

Thanks for listening to my ramblings. Credit repair seems to be able to do that to me. :D

If the CRA responds in any manner OTHER than a "remains" or "verified" or "deleted" it is NOT in violation. If the reporting CA or the OC responds to you directly as a result of your dispute, they are NOT in violation either as it is a "permissible business purpose" Or is the CA, acting for the OC, not bound by those laws? I do not know if a "PFD" will work or not work in ANY circumstance. Frequently it does NOT and your report would show a "paid" collection, ( which IS "correct" reporting).

 

I do not know what "other board" referred to the HIPAA letter program "not working". In many cases it does NOT work well, just as MOST credit repair methods do not always work well for everybody. Especially if people do not follow all the directions correctly. If you search on this board you will find that MOST of the people who have used the HIPAA letter program have been successful, and have posted their success.

 

I do not believe in ANY "PFD" with any CA because as a matter of PRINCIPLE I do not believe in paying ANY CA a RED CENT .

I understand. But, if you send the pre-hippa letter, and the CRA replys with the the type of service, will they just reply with "medical". That is not a violation. But, if they respond with, for instance, extraction for cavity, isn't that a HIPAA violation. From what I understand, the CA cannot respond that way because they should not be privy to that information. Obviously, the small collections on my report can be paid and I will not pay a CA for the simple reason that I owe them nothing. IN several cases, I received NOTHING from the CA. I thought they were required by law to send a dunning letter. Of course, I realize that there is no way I can prove that I didn't receive anything. That's neither here nor there I guess. Please don't misunderstand, I am not second guessing you. It appears that you have spent much time researching and sharing your findings with others and for that I am truly grateful. I will follow your instructions to the letter and see how things pan out. After all, it can't hurt can it? The collections are there and the only thing that could happen is that I could get lucky, or they could remain. Thanks for the reply.

All they can do is delete, say verified or say previously investigated or frivolous. Any ACTUAL response with ANY of the medical data MUST come from the CA or OC That is not a violation. You followed the WHOLE HIPAA letter program??

You sent the medical dispute letter??

You paid the OC with the HIPAA letter insert "a"

You re-disputed to the CRA and sent a copy with the cover letter to the OC??

 

You are saying that your response from your dispute to the CRA was a CHANGE from "paid" to $129. due??

 

If so, redispute to the CRA as follows.

Please advise the status of account # xxxx from ( name of CA)on my report # xxxxxx.

This account has been properly disputed and has been changed without any valid explanation from a paid medical account to an unpaid account for $129.on an unknown claim from ( name of CA).

 

This violation of proper procedures under the FCRA and FACTA has seriously affected my credit standing and interfered with my business. I will be filing the appropriate complaints and taking legal action to recover damages in 10 days from your receipt of this letter.

 

Send this CMRR to the Compliance Dept. of Experian

Yes, I followed the program except for the medical dispute letter. You had said to an earlier post of mine that I did not need to send that letter since collection was from 10/06 and I knew it was mine.

 

What happens if it is just updated to "paid" with $0 balance again? Do I then have any recourse? I've kept copies of all of the credit reports.

If it is updated to paid, then you can follow through with the rest of the HIPAA letter process, i.e. the "courtesy letter" to the OC and filing a complaint with the OCR.

 

You can't do that now, because the CA is NOT reporting the "paid" status. :beee:

The account became "unpaid" after the letters, but I'll try again. This has just become a thorn in our sides.

 

Thank you for the help! Letter goes out on Monday.
