Is there any type of recourse that can be done in regard to Student Loans besides contacting the Ombudsman?

 

I am going through the Ombudsman now, but what can be done other than that?

 

My latest debacle is that the student loan collection agency decided to change my minimum payment amount due. It's like these guys can just do what they want and we just have to take it. That's great for those that purposely avoid paying, but I have 3 solid years of payments on a 9 month rehab. All documented and on time.

 

My attorney says he doesn't know anything about Student Loans, and we let it go with that.

Is there any certain type of attorney I should be looking for? Any specific qualifications?

 

This is totally purple.

In the last week I had two interesting things happen...

 

The CA sent changed my payment amount due which I wrote in this post. Now today, I get a new rehab agreement that looks like the last 3. The last one they said they did not have on file, so they sent me a new in April 2007 that predated my payments to start from 9 months earlier at July 2006. I signed and sent it back. The call me saying I need a new one because I did not return this agreement until April and it is late. (I faxed it back, the day after receiving it with the date of April 2007 on it)

 

Now, today I get an agreement dated July 2007 with my payments beginning October 2006. It has my first payment predated again. The are doing this because I have 3 years of payments. They are trying to use my last 9 payments. If history repeats itself, I will send this back tonight with todays date, and they will claim they sent it to me in October but I am sending it back today.

 

Ok, I am ranting because this is crazy. My point is: What should I do... Leave the date blank and put an explanation? That is what I am thinking.

 

Also, I saw in the other post that they can't force me to do auto debit. I am just going to put N/A in the bank info and send it back. Does that sound ok? If they try to play hard ball and force me into this, is there something I can quote to get them to back off?

 

I have the Ombudsman on this, but he does not return my calls with this, or any of the past calls.

Actually, the burden of proof is on THEM - tell them to send YOU proof of where it states you MUST use auto-debit.

 

When I filled out the forms, I just put "Refused" on the bank account information.

You know, I always forget this important thing! Thanks for the reminder. I really need to remember that more.

 

I am sending it off now and I just put N/A on there where the financial institution is.

 

I was going to leave the date blank and tell them to fill it in, but I accidentally dated it. The last time they sent me a new form it was predated by them and when I sent it back signed and with the actual date, they claimed that I sent it back late.
