My mother was confined to a nursing home for the last siux months of life and coudl do nothing for herself (massive stroke - long story).

 

Anyway, I had power of attorney for her affairs and when she went to the nursing home I had a ton of papers to sign on her behalf. Well, when she died (almost six years ago) the balance due to the nursing home got on my credit report - in spite of the fact that I deliberately chose NOT to sign the agreement paper that said I would take over the debt.

 

How do I get it off my report? It is about $12K.

Ordinarily I would suggest the medical dispute letter, but in THIS case I think THIS letter will work better:

 

Send a dispute as follows:

 

Dear CRA

My Name is xxxx

My SS # is xxx xx xxxx

I am sending this dispute certified mail # xxx to make sure you receive it.

 

On my credit report # xxxxx the following account is inaccurate

Account # xxxxx

 

I have no record of this account from this creditor

for this date for this amount

 

Any account I may have had in the past with any similar creditor

would have had a date of last activity over 7 years ago and would be

obsolete.

 

If this account is verified, please furnish me with the

name and address of the verifying party,the method of verification, and

the reported first delinquency from the original creditor.

 

Sincerely,

 

Make sure you use personalized stationery,and if you are doing it on

your computer ( hand written is best)use purple or teal italic font.

HAND ADDRESS the envelope and send it certified, but NOT RR.

 

 

 

Make sure you have opted out FIRST, and if you have moved since 6 years ago, get old addresses deleted.

I think I opted out about three years ago by phone. Is there a way to check - or how can I do it again - just in case?

 

I have not moved - unfortunately. However, I think they had a PO box for me and, if so, that changed about five years ago.

For the same reason you need to use an unscannable font. It identifies your dispute as coming from a CONSUMER, not a lawyer or CRO.

 

Mail that must be signed for is directed to a different Dept. :blush:
